Access Hours. Unless otherwise agreed by the Contract Administrator, the hours of access applicable to the Contractor's Activities to be carried out on Site are those set out in the Contract Particulars.

To the extent of any inconsistency between the MFPE and the National Construction Code, the MFPE prevails. Commonwealth may Act The Commonwealth may, either itself or by a third party, perform a Contract obligation which the Contractor was obliged to perform but which it failed to perform. The costs, expenses, losses, damages and liabilities suffered or incurred by the Commonwealth in so performing such a Contract obligation will be a debt due from the Contractor to the Commonwealth. Applicable Standards The Contractor acknowledges that Annexure 9 identifies: the Australian standards which are applicable to the Contractor's Activities and the Works; or in the absence of an applicable Australian standard, the relevant international standards which are applicable to the Contractor's Activities and the Works, (Applicable Standards). Subject to paragraph (c) and without limiting the Contractor's obligations under this Contract, the Contractor must comply with the Applicable Standards in performing the Contractor's Activities and executing the Works. Where there is an ambiguity, discrepancy or inconsistency between any Applicable Standard and the Contract, any other Project Document, the MFPE or the National Construction Code, the higher standard, quality or quantum will prevail. The PDS Contractor may, at any time, request that the Contractor provides: a certificate which certifies that the design prepared by the Contractor under clause 5.1, the Works or any Section (as the case may be) complies with the Applicable Standards; and a corresponding certificate from each relevant subcontractor whic...

Imported Items Clause 8.24 does not apply unless the Contract Particulars state that it applies. The Contract Price will be adjusted in respect of any imported item required for the Works as specified in the Contract Particulars for which there has been an exchange rate fluctuation between the rate: lodged by the Contractor in its tender for the Contractor’s Activities as set out in the Contract Particulars; and prevailing at the date upon which the Contractor pays the applicable subcontractor for the imported item. In these circumstances, the Contract Price will be adjusted by the difference in the cost of the imported item (in Australian dollars) calculated using the information lodged by the Contractor in its tender as set out in the Contract Particulars on the basis of the exchange rate: so lodged by the Contractor; and prevailing at the date upon which the Contractor makes a payment to the applicable subcontractor for the imported item. The exchange rate in paragraph (c)(ii) will be that quoted by the same bank from which the exchange rate in paragraph (c)(i) was obtained. Access Hours. You shall have access to the Unit in accordance with the access hours set by Storage Solutions in its sole discretion, provided that You are not in default under this Agreement.

Access Hours. Subject to clauses 5 .2 and 5.3, You may access Your Space during the access hours of the Premises (which can be found at the Premises or on the Operator’s website) or as otherwise notified by the Operator from time to time ("Access Hours"). It is necessary for the Operator to be able to determine when the Centre will and won’t be accessible by customers for various reasons including security, costs, safety and other business reasons. As such, You acknowledge and agree that the Operator may change the access hours at its discretion and that it is reasonable for it to do so as part of its operation of the Centre.
