Abstention. Where it has been determined that a bias or apprehension of bias exists, the person with regard to whom such bias or apprehension exists shall refrain from further participation in the making of any recommendation or decision or participating in the process leading to a recommendation or decision concerning the Member who is the subject. Refraining from participation means withdrawing from all or any portion of a meeting where the subject matter of the bias or apprehension of bias will be discussed.
Abstention. Either party may abstain from voting on the terms and conditions of this Agreement but such abstention must be in writing and signed by all parties. Abstention by either party of breach of contract by the other parties under certain circumstances shall not be regarded as abstention by such party in similar case of breach of contract under other circumstances.
Abstention. The failure of either Party to exercise any right, power or privilege under the Agreement shall not be treated as a waiver of the same. The single or partial exercise of any right, power or privilege shall not exclude the exercise of any other right, power or privilege.
Abstention. Any Representative may abstain from voting in any vote of the Member Committee of a Series. In any such case, such Representative’s vote shall not be counted for purposes of determining the satisfaction of any voting or consent requirement for action by the Member Committee of such Series and shall be excluded from the denominator for purposes of determining the satisfaction of any required voting percentage.
Abstention. Any Party’s failure to exercise the rights under this Agreement in time shall not be deemed as its waiver of such rights and would not affect its future exercise of such rights.
Abstention. Identify that you are willing to accept a roommate at any time as directed by Residential Life, which includes leaving the open space available for move-in at all times.
Abstention. No failure or delay by the pledgee to exercise any right, remedy, power or privilege under this Agreement shall constitute a waiver of such right, remedy, power or privilege, and the pledgee’s exercise of any right, remedy, power or privilege, alone or in part, shall not preclude the pledgee’s exercise of any other right, remedy, power or privilege. The rights, remedies, powers and privileges set forth in this Agreement are cumulative and shall not exclude the application of any rights, remedies, powers and privileges provided by law.
Abstention. Either party may waive the terms and conditions of this Agreement, provided that they are in writing and signed by all parties. A waiver by a party in respect of a breach by another party in one case shall not be deemed to have waived by that party in respect of a similar breach in other circumstances.
Abstention. As any of the parties waives the right of this agreement, it must sign a written document as the proof. The right, power or remedy of any party under delay or failure to exercise this agreement should not be regarded as abstention. Exercising the right, power or remedy under the part of this agreement should not rule out further exercise of such rights, powers or remedies or the exercise of other rights, powers or remedies. Without limiting the provisions above, if one party waives to investigate the other party’s breach to the provisions of this agreement, it should not be viewed as its giving up investigating the breach of this provision or any other provision in the further.
Abstention. Either party may abstain from the terms and conditions hereof. The abstention shall only be effective when made in writing and signed by both parties. The abstention of one party caused by the breach of the other under certain circumstances shall not be deemed as abstention of a similar breach of contract by that party under other circumstances.
