02a. All expenses of the arbitration shall be equally divided between the parties, except that if one party cancels the arbitration after the date has been set that party shall bear all costs associated with the cancellation. Any Operator who is a witness will be released without loss of compensation.
02a. A member shall have access to examine the member’s personnel/HR file upon prior arrangement with the Human Resources Department. The member must receive prior approval from the immediate supervisor should the arrangement to view the file be made during working hours. Such approval shall not be unreasonably withheld.
02a. The employer shall hold a meeting with the employee in order to discipline or discharge an employee. The employee and the union shall be advised of the scheduling of such meeting on the previous working day. The employee shall be advised of their right to have Union representation at such meeting. Such employee has the right to be accompanied and advised by a Union representative at such meeting.
02a. The Union further recognizes the right of the Company to operate and manage its business in all respects in accordance with its commitments and responsibilities. The location of the plants, the products to be manufactured, the schedules of production, the methods, processes and means of manufacturing used, the right to decide on the number of employees needed by the Company at any time, the right to use improved methods, machinery and equipment and jurisdiction over all operations, buildings, machinery, tools and employees at the Company are solely and exclusively the responsibility of the Company. The Company also has the right to make, alter from time to time, and enforce reasonable rules and regulations to be observed by the employees. These rights will not be exercised in an arbitrary or unjust manner contrary to the expressed provisions of this agreement.
02a. An employee will have five (5) calendar days following written notification to indicate their choice. Failure to indicate within the above time limit will be deemed to mean that the layoff or reduction is accepted.
02a. Where a temporary full-time vacancy is posted, there shall be two categories of posting:
02a. The Arbitration Board shall take office within one (1) week of its having been constituted.
02a. An employee shall be entitled to holiday pay for the above holidays as set out in Clause 15.01 (a) as follows:
02a. (a) If a replacement situation is expected to last nine (9) months or more:
02a. The Company will inform the Union of the establishment of a new or substantively changed classification of work within the bargaining unit and the subsequent revisions, if any, to Article 27. If the Union does not consider the rate, assigned to the new classification under Article 28 proper, then the matter may be subject to the grievance procedure commencing with the Director of Operations or his/her designate in accordance with Section 18.03.
