Net Capital Expenditures definition

Net Capital Expenditures means for any period the amount by which Capital Expenditures during such period exceeds reimbursements for such items during such period from any fund established pursuant to the Loan Documents.
Net Capital Expenditures means Capital Expenditures minus the sum of (a) any financing used in connection with such expenditures (including, without limitation, any financing of capital improvements provided by a landlord and recovered through rental payments), and (b) amounts actually incurred in connection with Capital Expenditures made in connection with the Facilities up to an aggregate amount not to exceed the amount of funds deposited into the Restricted Balance Account established under the Term Loan Agreement.
Net Capital Expenditures means, with respect to any fiscal period Borrowers, the sum of all Capital Expenditures made during such fiscal period less the amount of cash proceeds received by Borrowers from sales of Equipment made during such fiscal period in accordance with the terms of this Agreement.

  • In each Fiscal Year thereafter, Net Capital Expenditures shall not exceed the sum of $8,200,000 plus twenty-five percent (25%) of Consolidated Net Earnings in respect of such Fiscal Year; provided, however, that if Consolidated Net Earnings is less than zero in any Fiscal Year, Consolidated Net Earnings shall be deemed to be zero in such Fiscal Year for purposes of this Section 2.13(a).

  • Net Capital Expenditures equals net cash flows from investing activities.

Net Capital Expenditures means for any Fiscal Year, means all Capital Expenditures incurred during such Fiscal Year, whether in connection with opening of a new retail store location, replacement of capital assets, renovation of existing store locations or otherwise, minus the sum of (x) any tenant allowance payments actually received by Borrowers during such Fiscal Year in cash in respect to new retail store locations opened in such Fiscal year, and (y) any insurance proceeds used for Capital Expenditures.

Net Capital Expenditures means, during any period of determination, Borrower’s: (a) property, plant and equipment at the end of such period (including that held under capitalized leases), less (b) property, plant and equipment at the beginning of such period (including that held under capitalized leases), plus (c) depreciation during such period.

Net Capital Expenditures means, for any Person and period of its determination, without duplication, (a) the amount of Capital Expenditures of such Person (other than Equity Funded Capital Expenditures and Capital Expenditures that constitute a Permitted Acquisition) minus (b) the aggregate Net Cash Proceeds resulting from sales, conveyances and other dispositions of Property (other than Nonordinary Course Asset Sales) and received by such Person during such period; provided that, the aggregate amount of Net Cash Proceeds under this clause (b) may not exceed $5,000,000 in any fiscal year.
Net Capital Expenditures means, for any period, Capital Expenditures for such period plus (without duplication) (i) any increases in the aggregate amount of advances or deposits made in connection with Capital Expenditures during such period, and (ii) the amount by which the aggregate principal amount of any Indebtedness incurred pursuant to Section 6.3(a)(i) ("Purchase Money Debt") was reduced in connection with any refinancing of interim Purchase Money Debt during such period, minus (without duplication) (x) the aggregate principal amount of any Purchase Money Debt incurred during such period, including without limitation in connection with any increase in Purchase Money Debt incurred in connection with any refinancing of interim Purchase Money Debt, and (y) any decreases in advances or deposits made in connection with Capital Expenditures during such period.
