EN shall prepare and submit an Annual Budget by December 1st of each year, covering the following Fiscal Year (July 1st through June 30) during the Term.
Notwithstanding any other provision of this Contract, the County will not be obligated for Contractor’s performance hereunder or by any provision of this Contract during any of County’s future Fiscal Years unless and until the County’s Board of Supervisors appropriates funds for this Contract in the County’s budget for each such future Fiscal Year.
Each Fiscal Year during the Term of the Agreement an amount of no less than $1,600,000 will be allocated by the City for Services under this Agreement.

The Pledged Revenues are reasonably expected to equal or exceed—from the Fiscal Year in which the Closing Date occurs and, on an ongoing basis during each Fiscal year of the Agreement Term—one hundred percent (100%) of the maximum annual principal and interest due on all outstanding obligations of the Borrower/Grantee payable from the Pledged Revenues.
