Leave Employee definition

Leave Employee has the meaning set forth in Section 4.12(4).
Leave Employee means any Business Employee who, as of the Effective Time, (i) is on a Leave of Absence or receiving long-term disability benefits under a Parent Plan or a SpinCo Plan and (ii) is not a Retained Employee.
Leave Employee has the meaning given to it in Section 6.15(b).

Examples of Leave Employee in a sentence

  • Sick Leave: Employee is entitled to sick leave in accordance with the terms as authorized from time to time by the Company.

  • For the avoidance of doubt, options vested prior to the Maternity Leave Employee having taken maternity leave shall not be forfeited.

  • Unless otherwise required by applicable law, the Applicable CBA or otherwise under the policies and practices of the Parent Group, SpinCo and its Affiliates shall have no obligation hereunder to employ or offer employment to any Leave Employee who becomes a Leave Employee prior to the Interim Transfer Date later and who is not cleared to return to work or who otherwise fails to present himself of herself for active work within twelve (12) months following the Effective Time.

  • Any Business Employee who becomes a Leave Employee on or after the Interim Transfer Date shall be treated as a Transferred Employee for all purposes of this Agreement.

  • The foregoing sentence shall not apply to any Leave Employee who is employed by a member of the SpinCo Group as of immediately prior to the Interim Transfer Date or whose employment automatically transfers to a member of the SpinCo Group by operation of Law, in which case the appropriate member of the SpinCo Group shall be responsible for providing such Leave Employee disability benefits and any other rights conveyed to such Transferred Employee at applicable law.

Leave Employee means any Employee who is on short-term disability leave, long-term disability leave, pregnancy or parental leave, absent and in receipt of workers' compensation benefits or on any other form of approved leave, as of the Effective Time.
