The Allies enjoy wide discretion in drafting their security regulations. Article 63, paragraph 1) simply requires that the measures taken be “necessary for the satisfactory fulfill- ment” of the Force’s defense responsibility. The only check that has been incorporated is the word “necessary.” Its impli- cation is that any measures deemed “necessary” must be pro- portional to the intended result to be achieved.

Prepayment Premiums will be distributed on any Distribution Date only to the extent they are received in respect of the Mortgage Loans in the related Prepayment Period.
