Parking Area. Developer shall provide a parking area for ADOT for at least 100 vehicles 27 (85 staff/15 visitors). The parking area must be reasonably level (all-weather surface and 28 all-weather access). The parking area must include an additional lockable fenced 29 parking area to accommodate 25 ADOT vehicles.

Parking Area. All Common Area (except sidewalks and service delivery facilities) now or hereafter designated by Landlord for the parking or access of motor vehicles, including roads, traffic lanes, vehicular parking spaces, landscaped areas and walkways, and including any parking structure constructed during the Term. Landlord and/or its successors may, by written notice to Tenant, elect in their sole discretion to increase and/or decrease the Parking Area from time to time during the Term for any reason whatsoever (including without limitation an election by Landlord and/or its successors in their sole discretion to make changes to the buildings situated in the Project, and/or to subdivide, sell, exchange, dispose of, transfer, or change the configuration of all or any portion of the Parking Area from time to time), so long as such changes to the Parking Area do not reduce the number of parking spaces available for Tenant's use below the minimum requirements set forth in PARAGRAPH 37 for a period of sixty (60) consecutive days or more. No such subdivision, sale, exchange, disposition, transfer, or change to the configuration of all or any portion of the Parking Area shall cause the Parking Area to be increased or decreased unless and until Landlord has given Tenant written notice of such increase or decrease.

Parking Area. Throughout the Term and subject to compliance with all applicable laws, rules, regulations, ordinances and Declaration, including without limitation the Exception Documents, Tenant and its agents, employees, invitees and customers shall be entitled (i) to the exclusive use of all parking spaces, which currently includes 59 covered parking spaces (the “Original Covered Parking Spaces”) and areas located on Parcel 1 and Parcel 2 (together, the parking spaces, including the Original Covered Parking Spaces, and parking areas located on Parcel 1 and Parcel 2 are hereinafter referred to as the “Parking Area”), (ii) to the use of such Parking Area for the overnight and valet parking of customer vehicles or company-owned vehicles, and (iii) to install awnings or other protective cover for vehicles and to reconfigure parking spaces and traffic patterns at the Premises as Tenant may deem appropriate to operate its business. Tenant agrees to pay Landlord, as Additional Rent on the first day of each month of the Term, an amount equal to Two Thousand Six Hundred Fifty-five Dollars ($2,655.00) per month for the Original Covered Parking Spaces; provided, however, should Tenant increase the number of covered parking spaces, Tenant shall not be required to pay any additional amount for such additional covered parking spaces. The Parking Area shall include without limitation the automobile parking stalls, driveways, entrances, exits, sidewalks and attendant pedestrian passageways and other areas designated for parking. Nothing contained in this Lease shall be deemed to create liability upon Landlord for any damage to motor vehicles of visitors or employees, unless ultimately determined to be caused by the gross negligence or willful misconduct of Landlord. Landlord shall pay Tenant, within thirty (30) days after Landlord’s receipt from Tenant of evidence substantiating said cost, the amount to reimburse Tenant for all actual, out-of-pocket costs incurred by Tenant to provide first class valet parking services in the Parking Area as deemed necessary by Tenant for Tenant’s use and occupancy of the Premises. The costs for the valet parking services in the Parking Area shall be commercially reasonable and at a cost comparable to those charged in arm’s-length transactions for similar services rendered for similar purposes to comparable buildings in the Las Vegas area. Parking Area. Tenant for itself, its employees, customers and invitees, shall have the non-exclusive right during the Lease Term and all renewals thereof, to use the parking area, adjacent to the Building, in common with Landlord and Landlord’s other tenants, their employees, customers and invitees. Said parking area shall be for the joint use of Landlord and all tenants in the Park and for the use of the customers, employees, visitors, and invitees of said tenants for driveway, walking or parking purposes. If an employee parking area is established, Tenant shall require Tenant’s employees to park therein. Tenant shall not at any time interfere with the right of Landlord and Landlord’s other tenants, their employees, customers and invitees, to use any part of said parking area.
