Nezávislý dodavatel. Vztah jedné strany ke straně druhé je vztahem nezávislého dodavatele a ani jedna strana nemá právo druhou stranu zavazovat nebo jednat jejím jménem.
Nezávislý dodavatel. Pro účely této Smlouvy jsou Smluvní strany nezávislými smluvními stranami a nic obsaženého v této Smlouvě se nevykládá tak, xxx xx postavilo do vztahu mezi partnery, zmocnitelem a zmocněncem, zaměstnavatelem a zaměst- nancem nebo účastníky společného pod- niku. Smluvní strany také souhlasí s xxx, že žádná z nich nemá pravomoc ani právo zavazovat nebo vázat druhou Smluvní stranu a že žádná z nich nebude vystupovat tak, jako by takovou pravomoc měla.
Nezávislý dodavatel. Institution and Principal Investigator are acting in the capacity of independent contractors hereunder and not as employees or agents of Xxxxxxx. Poskytovatel a hlavní zkoušející jednají v postavení nezávislých dodavatelů podle této smlouvy, nikoli jako zaměstnanci nebo zástupci společnosti Janssen.
Nezávislý dodavatel. Zdravotnické zařízení a Zkoušející jsou nezávislými dodavateli a nic v této smlouvě nesmí být považováno za vytvoření společného podniku, partnerství nebo jiného vztahu mezi smluvními stranami kromě nezávislého dodavatelsko-odběratelského vztahu.
Nezávislý dodavatel. The relationship of both Covance and the Sponsor with the Investigator and the Institution under this Agreement shall be that of an independent contractor, and nothing in this Agreement or otherwise or the arrangements for which it is made shall constitute Investigator or Institution, or anyone furnished or used by the Investigator or the Institution in the performance of the services contemplated by this Agreement, as an employee, joint venturer, partner, or servant of Covance or Sponsor. The Investigator and Institution acknowledge that Covance is acting on behalf of the Sponsor and that Covance’s ability to make the payments to the Institution depends not only on the Institution’s and Investigator’s complete performance of obligations under this Agreement and other terms and conditions specified here, but also on Covance receiving from the Sponsor the funds necessary to make the payments contemplated herein. To the extent that the Institution has fulfilled all relevant obligations hereunder and Covance has not received the funds necessary to make such payments, then the Institution hereby agrees that sole recourse shall be against the Sponsor. Zkoušející a poskytovatel si jsou vedomi toho, že společnost Covance jedná jménem zadavatele a že schopnost společnosti Covance poukazovat platby poskytovateli závisí nejen na úplném splnení závazků poskytovatele a zkoušejícího v rámci této smlouvy a jiných zde uvedených smluvních podmínek, ale také na tom, zda společnost Covance obdrží od zadavatele finanční zdroje potšebné k vyplacení zde plánovaných plateb. Pokud zkoušející a poskytovatel splní všechny své relevantní závazky v rámci této smlouvy a společnost Covance neobdrží potšebné finanční zdroje, aby tyto platby mohla realizovat, poskytovatel tímto souhlasí, že nápravu bude vyžadovat výhradne od zadavatele.
Nezávislý dodavatel. 17.1 The relationship of Institution and Investigator to CRO is that of independent contractor. Institution and Investigator commit themselves to perform the Services only as independent contractor and nothing contained herein shall be construed to be inconsistent with that relationship or status. Institution, Investigator, and Study Personnel shall not be considered employees or agents of CRO or SPONSOR and, as such, shall not be entitled to any benefits available to employees of CRO or SPONSOR. Institution represents and warrants that it is an employer subject to, and shall comply with, all Applicable Laws. 17.1 Vztah zdravotnického zařízení a zkoušejícího lékaře k CRO je vztahem nezávislého dodavatele. Zdravotnické zařízení a zkoušející lékař se zavazují, že poskytnou služby pouze jako nezávislí dodavatelé a nic obsaženého v této smlouvě nebude vykládáno tak, že odporuje tomuto vztahu nebo statutu. Zdravotnické zařízení, zkoušející lékař a pracovníci účastnící se studie nebudou považováni za zaměstnance nebo zástupce CRO nebo ZADAVATELE a jako takoví nebudou mít nárok na žádné benefity poskytované zaměstnancům CRO nebo ZADAVATELE. Zdravotnické zařízení prohlašuje a zaručuje, že je zaměstnavatelem podléhajícím a splňujícím platné právní předpisy.
Nezávislý dodavatel. 15.1 The relationship of Institution to CRO is that of independent contractor. Nezávislý dodavatel. Pši provádění klinického hodnocení jedná zkoušející i poskytovatel jako nezávislý dodavatel vůči CRO a zadavateli a nikoliv jako zástupce, partner nebo zaměstnanec CRO nebo zadavatele. Zkoušející, poskytovatel ani žádný z jejich pšíslušných zaměstnanců, zástupců nebo dodavatelů nemají žádné oprávnění uzavírat smlouvy s tšetími stranami, kterými by byli vázáni CRO nebo zadavatel 19. Independent Contractor. In conducting the Study, Investigator and Institution will each be acting as an independent contractor with respect to CRO and Sponsor, and not as an agent, partner, or employee of CRO or Sponsor. Neither Investigator, Institution, nor any of their respective employees, agents, or contractors, shall have any authority to make agreements with third parties that are binding on CRO or Sponsor.

It is agreed by the Parties that Institution and Principal Investigator are acting in the capacity of independent contractors hereunder and not as employees, agents or joint venturers of or with Sponsor. Neither Institution nor Principal Investigator shall have any authority to represent, bind or act on behalf of Sponsor. Smluvní strany se dohodly, že zdravotnické zařízení a hlavní zkoušející působí podle této smlouvy ve vztahu k zadavateli jako nezávislí smluvní dodavatelé, a nikoliv jako jeho zaměstnanci, zástupci nebo osoby společně podnikající v rámci něj nebo spolu s ním. Zdravotnické zařízení ani hlavní zkoušející nebudou mít žádnou pravomoc zastupovat nebo zavazovat zadavatele ani jednat jeho jménem.

The Institution and Principal Investigator shall conduct the Study under this Agreement only as an independent contractor, and nothing contained herein shall be construed to be inconsistent with that relationship or status. The Institution, Principal Investigator and Study Personnel shall not be considered employees or agents of Sponsor and, as such, shall not be entitled to any benefits available to employees of Sponsor. This Agreement shall not constitute, create, or in any way be interpreted as, a joint venture, partnership, or business organization of any kind. Instituce a hlavní zkoušející budou provádět klinické hodnocení podle této smlouvy pouze jako nezávislý dodavatel a žádné položky v tomto dokumentu nebudou interpretovány jinak než v souladu s tímto vztahem či stavem. Instituce, hlavní zkoušející a pracovníci klinického hodnocení nebudou považováni za zaměstnance ani zprostředkovatele zadavatele a jako takoví nebudou mít nárok na výhody, které mají k dispozici zaměstnanci zadavatele. Tato smlouva nebude zakládat, vytvářet ani nebude žádným způsobem vykládána jako společný podnik, společenství nebo obchodní organizaci jakéhokoli druhu.
