Common use of Extension of Time Clause in Contracts

Extension of Time. While it is anticipated that all applications of the Contractor for additional time or extensions of the Material Completion Date would have been filed and determined by the Owner prior to the Material Completion Date, the Contractor may, within 10 days after the Material Completion Date, file for any additional extensions of time pursuant to Section 3, Part 4, and the collection, but not the accrual, of Liquidated Damages shall be suspended until the Owner’s decision. Should such a belated application be filed after the 10-day period, the Owner, in its sole discretion, may continue to collect Liquidated Damages. Should the Owner grant any applications for extension of time and the Material Completion Date, Liquidated Damages shall be adjusted accordingly.
