Common use of Sick Leave Clause in Contracts

Sick Leave. (a) In the first contract year of his full time employment each regular employee who has worked continuously for 3 months shall be entitled to receive a maximum of 9 days of sick leave with pay in each contract year provided that if the employee has not worked 12 months during his first contract year, sick leave will be pro-rated. Each employee who has worked continuously for 3 months shall be is entitled to receive a leave of absence for sickness, injury, and emergency with full pay at the rate of 1.08 days per month to a total of 13 days per year. An employee may draw up to a maximum of 9 13 days of sick leave with pay in each contract year provided that if for the employee has not worked 12 months during his first contract current year, but if that employee terminates his or her employment the salary paid for the unearned sick leave days expended will be pro-rateddeducted from that employee’s last pay check. In succeeding contract years Sick leave may be taken in one (1) hour increments. Sick leave not used in the employee shall receive the full amount year of sick leave above mentioned without pro ration. All unused sick leave at the end of each contract year service for which it is granted shall be paid in a lump sum. A contract year means the period October 1 accumulated up to September 30maximum of 120 days for subsequent years.

Sick Leave. A. Except for conversion of sick leave benefits pursuant to the Public Employees Retirement Act, sick leave shall not be paid in a lump sum.
