Xxxxxxx Improvements means any material modification, enhancement or improvement to the DBS made by the Xxxxxxx Group within two (2) years following the Distribution Date.

Examples of Xxxxxxx Improvements in a sentence

  • Any review of the items set forth in this Article III performed by the City or its representatives is not intended to and shall not be construed as an undertaking of the City to provide adequate and accurate Engineering Plans for the Xxxxxxx Improvements.

  • The related infrastructure that will be included in the Xxxxxxx Improvements shall be specified on Exhibit L attached hereto, and all other infrastructure improvements shall be excluded from the Xxxxxxx Scope of Work.

  • Following completion of the Engineering Plans, Developer, as the City's design and construction manager, shall engage in a competitive bidding process inviting only qualified bidders to participate and submit bids to act as the Contractor for the construction of the Xxxxxxx Improvements.

  • Developer, as the City's design and construction manager, shall be responsible for selecting the engineer (the "Engineer") for the Xxxxxxx Improvements, subject to the City's approval of the qualifications of the Engineer.

  • The City and Developer hereby agree that the Project consists of the design, development and construction of certain new facilities on the Project Site, including first-class luxury apartment buildings, Class A office buildings and a mixed-use retail and residential facility, including the TDD Improvements, the CID Improvements, Xxxxxxx Improvements and other improvements described in this Section 2.01 and as set forth on the Project Budget attached hereto and incorporated by reference herein as Exhibit H.

  • Developer, as the City's design and construction manager, shall cause the City's form contract documents to be used for all aspects of the Xxxxxxx Improvements (the "Contract Documents").

Related to Xxxxxxx Improvements

  • Licensee Improvements means Improvements created, conceived, or reduced to practice by or for Licensee.

  • Minimum Improvements means the acquisition of land and construction of a 64-unit market rate residential apartment building and related improvements. The Minimum Improvements are more fully depicted in Exhibit B, which is attached hereto and incorporated herein.
