This Bond is one of a duly authorized issue of bonds of the Authority designated “Colorado Housing and Finance Authority Federally Taxable Multi-Family/Project Class I Adjustable Rate Bonds 2020 Series D-2” (the “Bonds”), issued under and pursuant to the Act, the Indenture and the Supplemental Public Securities Act, constituting Part 2 of Article 57 of Title 11, Colorado Revised Statutes.
Prior to Conversion, Owners of Adjustable Rate Bonds (other than SAVRS Rate Bonds) may elect to tender their Adjustable Rate Bonds, which, if so tendered upon proper notice to the Remarketing Agent or Tender Agent, as applicable, in the manner set forth in the Mode Period Chart, will be purchased on such next Effective Rate Date (or, in the case of Adjustable Rate Bonds in a Daily Mode or a Weekly Mode, on the purchase date specified in the Tender Notice) at the Purchase Price.
Of the Bonds, $15,054,000 aggregate principal amount have been converted to Fixed Rate Bonds (as defined in the Indenture) or redeemed and $6,444,000 aggregate principal amount remain outstanding as Adjustable Rate Bonds.
The Authority has executed and delivered the Initial Interest Rate Contract having an effective date corresponding to the date of authentication and delivery of the Adjustable Rate Bonds, and may provide an Alternate Interest Rate Contract upon the termination of any Interest Rate Contract.
Of the Bonds, $2,876,000 aggregate principal amount have been converted to Fixed Interest Rate Bonds (as defined in the Reimbursement Agreement) or redeemed and $17,165,000 aggregate principal amount remain outstanding as Adjustable Rate Bonds.
