Common use of Use of Assets Clause in Contracts

Use of Assets. To Barnstable's knowledge, the present use of the Property conforms in all material respects to all applicable zoning, building, building line and similar restrictions, is a permitted "non-conforming use" as defined in such zoning, building, building line or similar restrictions or the Companies have obtained the necessary permits, variances or relief therefor. The Assets are located in the Town of Barnstable, Massachusetts.

Use of Assets. To Barnstable's knowledgethe Company’s Knowledge, the present use of the Property conforms in all material respects to all applicable zoning, building, building line and similar restrictions, is a permitted "“non-conforming use" ” as defined in such zoning, building, building line or similar restrictions or the Companies have Company has obtained the necessary permits, variances or relief therefor, except for any nonconforming uses that would not be expected to have a Company Material Adverse Effect. The Assets are all located in the Town Towns of BarnstableAvon, MassachusettsSimsbury and Farmington, Connecticut.
