Common use of University Clause in Contracts

University. University retains the right to use the Patent Rights for academic research, teaching, and non-commercial patient care, without payment of compensation to Company. University may license its retained rights under this Subsection 2.3(a) to research collaborators of University faculty members, post-doctoral fellows, and students.

University. University retains the right to use the Patent Rights for academic research, teaching, and and, solely with Company’s prior written consent, non-commercial patient care, without payment of compensation to Company. University may license its retained rights under this Subsection 2.3(a) ), other than its right to use the Patent Rights for non-commercial patient care, to research collaborators of University faculty members, post-doctoral fellows, and students.

University. University retains the right to make and use the Licensed Products covered by Patent Rights for academic research, teaching, research and non-commercial academic patient care, without payment of compensation to Company. University may license its retained rights under this Subsection 2.3(a) Section to research collaborators of University faculty members, to post-doctoral fellows, and studentsto students solely for academic research and academic patient care. Notwithstanding the above retention of rights, the University does not retain any right to make, use, or sublicense any third party the right to use the license or sublicense of its retained rights under this Section for commercial applications in the Field.

University may license its retained rights under this Subsection 2.3(a) Section to other academic or non-commercial research collaborators of University institutions (for use by faculty members, post-doctoral fellows, and students) solely for the purpose of practicing the rights retained under this Section and subject to terms of this Agreement, provided that University will promptly notify Company of any such license.

University. University retains the right to use the Patent Rights and Licensed Know-How for academic research, teaching, and non-commercial patient care, without payment of compensation to Company. University may license its retained rights under this Subsection 2.3(a) to research collaborators of University faculty members, post-doctoral fellows, and students.

University. University retains the right to use practice under the Patent Rights and to make and use Licensed Products and to perform Licensed Services for academic research, teaching, and non-commercial patient care, without payment of compensation to Company. University may license its retained rights under this Subsection 2.3(a) Section to research collaborators of University faculty members, post-doctoral fellows, and students.
