Presentment Prohibitions. You shall not present, or attempt to present, or allow others, either directly or indirectly, to present, or attempt to present, for deposit by any means (i) any substitute check that has already been presented for deposit via Mobile Deposit, or (ii) any original check, the substitute check of which has already been presented for deposit via Mobile Deposit. In the event that you or any third party, presents, or attempts to present, a deposit in violation of this subsection, you agree to defend, indemnify, and hold us and our agents harmless from and against all liability, damage and loss arising out of any claims, suits, or demands brought by third parties with respect to any such substitute check or original check. You agree that the aggregate amount of any items which are deposited more than once will be debited from your account, and to the extent funds in your account are insufficient to cover such amount, any balance shall be debited by us from any other deposit accounts with us in our sole discretion. You further acknowledge that you are solely responsible for the cost of processing and handling of any original items which are imaged and deposited utilizing Mobile Deposit and you assume all liability to the drawer of any item imaged using Mobile Deposit or liability arising from our printing of any substitute check from those images.

In the event that the you or any third party presents, or attempts to present, a deposit in violation of this subsection, you agree to defend, indemnify, and hold CCCU and its agents harmless from and against all liability, damage and loss arising out of any claims, suits, or demands brought by third parties with respect to any such Substitute Check or original check. You agree that the aggregate amount of any items which are deposited more than once will be debited from your account, and to the extent funds in your account are insufficient to cover such amount, any balance shall be debited by CCCU from any other deposit accounts with CCCU in its sole discretion. You further acknowledge that you and not CCCU are responsible for the processing and handling of any original items which are imaged and deposited utilizing the service and you assume all liability to the drawer of any item imaged using the service or liability arising from CCCU’s printing of any substitute check from those images.

Member agrees that the aggregate amount of any items which are deposited more than once will be debited from Member's account, and to the extent funds in Member's account are insufficient to cover such amount, any balance shall be debited by Credit Union from any other deposit accounts with Credit Union in its sole discretion. Member further acknowledges that Member and not the Credit Union is responsible for the processing and handling of any original items which are imaged and deposited utilizing the service and Member assumes all liability to the drawer of any item imaged using the service or liability arising from the Credit Union's printing of any substitute check from those images.
Presentment Prohibitions. You agree that you will not deposit Original Checks through Remote Deposit that are: • Payable to any person or entity other than you • Prohibited by, or received in violation of, any law, rule or regulation • Known to you or should be known to you to be fraudulent or otherwise not authorized by the owner of the account on which the item is drawn • Original Checks previously cashed or deposited • Post-dated or more than six (6) months old • Payable to cash • Irregular in any way • Original Checks that do not bear a signature of the person on whose account the Item is drawn or • Drawn on financial institutions located outside the United States

YOUR REPRESENTATIONS AND WARRANTIES You represent and warrant that: • You will comply with all federal and state laws, and rules and regulations applicable to online transactions, including those of the National Automated Clearing House for ACH transactions; • All items scanned through image transport are made payable to you; • All signatures on each item are authentic and authorized; and • Each item has not been altered. In the event you breach any of these representations or warranties, you authorize the Credit Union to charge your account for the amount of any such liability, damages, loss, demand, claim, or suit arising out of any breach of warranty claim under the provisions of the Texas Commercial Code or other relevant law, in addition to any and all other remedies available to the Credit Union. FINANCIAL RESPONSIBILITY You are, and shall remain, solely and exclusively responsible for any and all financial risks, including, without limitation, insufficient funds, associated with accessing and utilizing eDeposits. The Credit Union shall not be liable in any manner for such risk unless the Credit Union fails to follow the procedures described in materials for use of eDeposits. In the event that the Member, or any third party, presents, or attempts to present, a deposit in violation of this Subsection, the Member agrees to defend, indemnify, and hold SAFE and its agents harmless from and against all liability, damage, and loss arising out of any claims, suits, or demands brought by third parties with respect to any such Substitute Check or original check. Member agrees that the aggregate amount of any items deposited more than once will be debited from the Member's account, even if such deduction causes an overdraft to the Account, and to the extent funds in the Member's account are insufficient to cover such amount, any balance shall be debited by SAFE from any other accounts with SAFE in its sole discretion. Member further acknowledges that the Member, not SAFE Credit Union, is responsible for the processing and handling of any original items which are imaged and deposited utilizing MyDeposit Business service, and the Member assumes all liability to the drawer of any item imaged using the service or liability arising from SAFE's printing of any substitute check from those images.

In the event that you, or any third party, presents, or attempts to present, a deposit in violation of this Subsection you agree to defend, indemnify, and hold the Credit Union and its agents harmless from and against all liability, damage and loss arising out of or related to any claims, suits, or demands brought by third parties with respect to any such substitute check or original Check. You agree that the aggregate amount of any Items which are deposited more than once will be debited from your Account, and to the extent funds in your Account are insufficient to cover such amount, any balance shall be debited by Credit Union from any other deposit accounts with Credit Union in its sole discretion. In the event that the funds in your Account are insufficient, there may also be a fee assessed (refer to the current Fee Schedule which is incorporated here for reference). You further acknowledge that you and not the Credit Union are responsible for the processing and handling of any original Items which are imaged and deposited utilizing the service, and that you assume all liability to the drawer of any Item imaged using the service or liability arising from the Credit Union's printing of any substitute check from those images.

In the event the Consumer, or any third party, presents, or attempts to present, a deposit in violation of this Subsection the Consumer agrees to defend, indemnify, and hold us and our agents harmless from and against all liability, damage and loss arising out of any claims, suits, or demands brought by third parties with respect to any such substitute check or original check. Consumer agrees the aggregate amount of any items which are deposited more than once will be debited from Consumer's account, and to the extent funds in Consumer's account are insufficient to cover such amount, any balance shall be debited by us from any other deposit accounts with us at our sole discretion. Consumer further acknowledges the Consumer, and not us, is responsible for the processing and handling of any original items which are imaged and deposited utilizing the service and Consumer assumes all liability to the drawer of any item imaged using the service or liability arising from the printing of any substitute check from those images.
