PERMISSIBLE VARIATIONS. The Products sold hereunder shall be subject to Seller’s standard manufacturing variations, tolerances and classifications. It is expressly agreed that the quantity delivered by Seller may be up to five percent (5%) more or less than the quantity ordered and that Buyer shall accept and pay for such quantity, unless otherwise agreed in writing.

PERMISSIBLE VARIATIONS. Seller has the right, without giving notice to Xxxxx, prior to the delivery of Goods to Buyer to make any changes in the composition of the Goods which, in the opinion of the Seller, does not affect the general characteristics or properties of the Goods. In addition, Seller may make any change or variation in the Goods which is within government or industry standards or specifications applicable at the time of manufacture without giving notice to the Buyer. Buyer will accept any Goods which may incorporate any changes in the composition or specifications, and any increase in price resulting from such change will be paid by Buyer.

In addition, if the Goods to be supplied by Seller to Buyer hereunder shall be made specifically for Buyer and are not customarily carried in stock by Seller, then a ten percent (10%) overage or underage in delivery of the amount specified herein shall constitute fulfillment of the order and such Goods delivered will be paid for at the unit price specified herein.
PERMISSIBLE VARIATIONS. All Product(s) shall be furnished subject to the customary manufacturing and commercial variations and practices of Seller. Seller reserves the privilege of shipping underages or overages of quantity in accordance with its customary practices.
PERMISSIBLE VARIATIONS. All Products, including those produced to meet exact specifications, shall be subject to tolerances and variations consistent with usages of the trade and regular practices concerning dimension, weight, packaging, normal variations in surface, deviations from tolerances and variations consistent with practical testing and inspection methods, and practices concerning over- and under-count of Products. A shipping tolerance of +/- 10% of ordered quantity applies to all Products. All products are produced based on Seller’s specifications or mutually agreed upon (in writing) Buyer’s specification.
PERMISSIBLE VARIATIONS. In the case of sodium chloride sampled after deliver to the purchaser, tolerances from the foregoing specified values shall be allowed as follows: Gradation – 5 percentage points on each sieve size, except the 1/2 in. and 3/8 in. for Grade 1 and 3/4 in. for Grade 2. PERMISSIBLE VARIATIONS. The design portion of the Design-Build Work shall be completed in accordance with the Secondary Technical Criteria. In light of the design-build nature of this Contract and the partially completed level of the design work as of the Contract Date, however, reasonable, minor variations from the Secondary Technical Criteria shall be permitted in the final design of the Regional Water Facilities, to the extent such variations do not diminish the quality, integrity, durability, functionality and reliability of the Project. Examples of elements of the Secondary Technical Criteria from which there may be reasonable, minor variations in the final design include thickness, level and composition of individual structural members; exact dimensions of rooms and buildings (to the extent overall functionality is not impaired or total square footage materially decreased); routes and depth of pipe work; exact size, weight and height of mechanical components; and dimensions, ratings and positions of electrical, power and control cables, switchgear, transformers and control panels. No such variations shall be inconsistent with the Design and Construction Requirements, with the purposes of the Secondary Technical Criteria as set forth in subsection (A) of this Section, or with any limits specifically provided in the Secondary Technical Criteria regarding the range or nature of permissible variations or with any standards or principles regarding permissible deviations set forth therein. Variations in the final design from the Secondary Technical Criteria which conform to the provisions of this Section shall not require affirmative SRWA consent, but shall be identified in the monthly progress schedule and report provided in accordance with subsection 4.1(E) (Progress Schedule and Reports). However, if SRWA determines, in its discretion, that any such variation does not conform to this Section, then the variation shall require the written consent of SRWA, which shall not be unreasonably withheld or delayed. Any variation requiring the consent of SRWA shall be evidenced by a Contract Administration Memorandum or Change Order, as applicable depending upon the materiality of the change, as provided in Sections 10.3 (Contract Administration) and 10.4 (Change Orders).
