For example, we will not be liable under these circumstances: • If, through no fault of ours, you do not have enough money in your account to make the transfer; • If the transfer would go over the limit of your Check Protect or overdraft protection coverage; • If you used the wrong access code or you used an access code or card in an incorrect manner; • If the automated teller machine (ATM) where you are making the transfer does not have enough cash; • If the ATM or POS terminal was not working properly and you knew about the problem when you started the transaction; • If we have reason to believe the transaction may not be authorized by you; • If any required documentation has not been presented; • If the information provided by you or a third party is incorrect, incomplete, ambiguous, or untimely; • If circumstances beyond our control (such as fire, flood or power failure) prevent the transaction; • If the money in your account is subject to legal process or other claim; • If we process your payment transaction in a timely manner but the payee rejects your payment or fails to process it in a timely manner; • If you fail to follow service instructions on how to perform a transaction; • If your account has become dormant, in which case we may terminate your card or access code to that account; • If your account is frozen or has been revoked because of a delinquent loan; • If your card or access device has been revoked due to inactivity or at our discretion; • If the transaction cannot be completed because your card is damaged, or the ATM captures or retains your card; in which event you may contact Unitus about its replacement.
Our Liability for Failure to Make Transfers. If we do not properly complete a transfer to or from your Card on time or in the correct amount according to this Agreement, we will be liable for your actual losses or damages proximately caused by us. We will not be liable, for instance: • If, through no fault of ours or as provided in Section 7 hereto, your Card does not contain enough money to make the transfer. • If your funds are being held or frozen or are subject to legal process, court order, or other restriction prohibiting the transfer. • If the Terminal where you are making the transfer does not have enough cash. • If the Terminal (or system) was not working properly and you knew about the breakdown when you started the transaction. • If circumstances beyond our control (such as telecommunication or electrical outages and malfunctions, postal strikes or delays, computer system failures or natural disasters) prevent the transfer, despite reasonable precautions that we have taken. • If you have exceeded the limitations on frequency of transfers or dollar amount of transfers. • If your Card or PIN has been reported lost or stolen, or if we suspect that the Card or PIN is being used fraudulently or in breach of the terms of this Agreement, or if your Card has been damaged. • If we do not receive the necessary transfer data from a third party, or if such data is incomplete or erroneous when received by us. • If making the transfer would cause us to violate any law, rule or regulation to which we are subject. • If your Card funds are presumed abandoned under applicable law, or if we consider your Card to be dormant or inactive under our policies and procedures. • If a merchant, financial institution, or other party refuses to accept your Card. • If we have a reason to believe that the requested transaction is unauthorized. • If any failure on our part was not intentional and resulted from a bona fide error, notwithstanding procedures to avoid such error, except for actual damages (which do not include indirect, incidental, special or consequential damages). There may be other exceptions to liability stated in this Agreement or otherwise provided by applicable law.

We will not be liable, for instance: · If, through no fault of ours, your account does not contain sufficient collected funds to make the transfer. · If the money in your account is subject to legal process or other encumbrances restricting the transfer. · If a transfer system was not working properly and you knew about the breakdown when you started the transfer. · If an act of God or circumstances beyond our control (such as fire or flood) prevent the transfer or use of Service despite reasonable precautions that we have taken. · If incomplete or inaccurate information is forwarded to us by you or through an automated clearinghouse. · If you have not properly followed the instructions for using our Service. · For errors or failures from any malfunctions of your service provider, or other problems relating to the telephone equipment you use with our Service, including, without limitation, your inability to access the Service or any part of the Service. · For a failure to provide access or for interruptions in access to the Service due to Service system failure. · NOTWITHSTANDING ANY OTHER PROVISION IN THIS AGREEMENT, UNLESS OTHERWISE PROHIBITED BY LAW, OUR SOLE RESPONSIBILITY FOR AN ERROR BY US OR OUR THIRD PARTY PROVIDER IN TRANSFERRING FUNDS WILL BE TO CORRECT THE ERROR, BUT IN NO CASE WILL THE BANK BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH OR IN ANY WAY RELATED TO THE SERVICE.

However, there are some exceptions, including but not limited to, the following: We will not be liable to you if, • Through no fault of ours, you do not have enough money in your account to make the transfer. • The transfer would go over the credit limit on your overdraft line. • Circumstances beyond our control (such as communications, electronic or computer system failure, fire or flood) prevent the transfer or use of Online Banking, despite reasonable precautions that we have taken. • You have not properly followed the instructions for using Online Banking. • Your operating system is not properly installed or functioning properly. • The failure resulted from any malfunctions of your browser, Internet service provider or computer, computer virus or other problems relating to the computer equipment you use with Online Banking, including, without limitation, your inability to access Online Banking or any part of Online Banking. • The failure was the result of inaccessibility to Online Banking due to Online Banking system failure. • A legal order directs us to prohibit withdrawals from the account. • Your account is closed, or if it has been frozen. • You, or anyone authorized by you, commits any fraud or violates any law or regulation. Notwithstanding any other provision in this agreement, unless otherwise prohibited by law, our sole responsibility for an error by us or third party provider in transferring funds will be to correct the error, but in no case will we be liable for any indirect, special, incidental or consequential damages in connection with or in any way related to Online Banking.

However, there are some exceptions: •□If, through no fault of ours, there is not enough money in your account to complete the transaction, if any funds in your account necessary to complete the transaction are held as uncollected funds pursuant to our Funds Availability Policy, or if the transaction involves a loan request exceeding your credit limit. •□If you used your Card or access code in an incorrect manner. •□If the ATM where you are making the withdrawal does not have enough cash. •□If the error was caused by a system of any participating ATM network. •□If the ATM/ITM, POS terminal, telephone access system, Online Banking or Bill Pay system or other electronic service was not working properly and you knew about the problem when you started the transaction. •□If acts of God (including but not limited to fire, flood, or power failure) prevent the transaction. •□If circumstances beyond our control (such as your willful or negligent use of your Card, access code, or any EFT facility for making such transaction) prevent the transaction. •□If the money in your account is subject to legal processes or other claim. •□If you have bill payment services, we can only confirm the amount, the participating merchant, and date of the bill payment transaction made by the credit union. For any other error or question you have involving the billing statement of the participating merchant, you must contact the merchant directly. We are not responsible for investigating such errors. •□Any other exceptions as established by the credit union.
