OPERATIONS PERSONNEL/DRIVER QUALIFICATIONS. CONTRACTOR shall employ a sufficient number of drivers and support personnel to assure DISTRICT of continuous and reliable service. The CONTRACTOR shall, for the protection of pupils, take reasonable steps to ensure its drivers and other persons who have contact with the pupils and their families are of stable personality and high moral character. The CONTRACTOR shall assure that all the CONTRACTOR’s personnel meet these qualifications. The CONTRACTOR will not allow any person to drive a school bus whose conduct might in any way expose a child to any impropriety of word or conduct, nor shall CONTRACTOR allow any person to drive a school bus who is not in a condition of mental and emotional stability. The CONTRACTOR shall comply with Section 45125.1 of the Education Code of California. CONTRACTOR shall not knowingly permit its drivers to smoke on the bus nor to drink any intoxicating beverage or be under the influence of alcohol or drugs, prescription and non-prescription drugs, which impair the safe operation of the bus, while operating any bus. In accordance with the gang intervention program, certain items of clothing and accessories may be determined to be gang affiliated, and therefore, not permitted at school sites. Drivers must also adhere to this policy. It is therefore suggested that drivers avoid wearing items with specific sport team or identified logos other than school, school bus, or contractor related items. Any tattoos or body art that may be deemed offensive must be covered during the course of the driver performing their duties. CONTRACTOR shall be responsible for hiring and discharging personnel employed by CONTRACTOR to perform its obligations hereunder; provided, however, that DISTRICT shall have the right to require CONTRACTOR to remove from service under this Agreement any employee who, in DISTRICT's sole discretion, is deemed unsuitable for the performance of transportation services for DISTRICT; and provided further that DISTRICT shall make such request in writing and state the reasons therefor. CONTRACTOR shall ensure that the appropriate number of drivers are scheduled to work during normal school hours even when their route may not be running due to a school closure. Drivers scheduled for routes where school may not be in session should be used as the primary pool for the CONTRACTOR to backfill any open routes for operating school sites. OPERATIONS PERSONNEL/DRIVER QUALIFICATIONS. The Contractor shall employ a sufficient number of qualified drivers and support personnel to assure the District of continuous, reliable, safe and on time service. The Contractor shall take reasonable steps to prevent its employees from exposing any pupil to impropriety of word or conduct. The Contractor shall not knowingly permit its drivers to smoke on the bus nor to drink any intoxicating beverage or be under the influence of drugs or alcohol while operating any bus. The Contractor shall regulate the use of prescription and non-prescription drugs that impair the safe operation of the bus. The Contractor shall be responsible for hiring and discharging personnel employed by the Contractor to perform its obligations hereunder. However, the District shall have the right to require the Contractor to remove from service to the District any employee who, in the District’s sole discretion, is deemed unsuitable for the performance of transportation services for the District. Furthermore, the District shall make such a request in writing and state the reasons for removal. Reasons may include failure of any driver to operate a vehicle in a safe manner, in accordance with the laws of the State of Missouri and the ordinances of any city in which such vehicle operates or a finding by the District that the personal habits and/or conduct of any employee are detrimental to the best interests of the District or to the welfare and best interests of the pupils being transported.

The Contractor will consistently conduct a proactive recruitment campaign and periodically update the District on these efforts (may not be necessary to include). Contractor shall provide qualified drivers, trained and licensed in accordance with the laws of this State and the rules and regulations of District. Accordingly, Contractor agrees that each driver shall:

  • Personnel Qualifications Contractor shall assign properly qualified and experienced personnel to the program contemplated under this Agreement, and Contractor shall use reasonable efforts to retain such personnel on Customer’s program for the duration of such program.

  • Driver Qualifications All drivers shall be trained and qualified in the operation of collection vehicles, and must have in effect a valid license, of the appropriate class, issued by the California Department of Motor Vehicles. Contractor shall use the Class II California Department of Motor Vehicles employer “Pull Notice Program” to monitor its drivers for safety.

  • Professional Qualifications It shall be a condition of continued professional employment that employees must apply for enrolment in their appropriate professional licensing body by the thirtieth day of continuous service.

  • Promotions Requiring Higher Qualifications Consideration for promotion shall be given to the senior applicant who does not possess the required qualifications but is presently obtaining such qualifications prior to filling the vacancy. At the discretion of the Employer, such an employee may be given a trial period to qualify within a reasonable length of time and will revert to her former position if the required qualifications are not met within such time.

  • PERFORMANCE AND RESPONSIBILITY QUALIFICATIONS The Commissioner reserves the right to investigate or inspect at any time whether or not the Product, services, qualifications or facilities offered by the Bidder/Contractor meet the requirements set forth in the Bid Specifications/Contract or as set forth during Contract negotiations. Contractor shall at all times during the Contract term remain responsible and responsive. A Bidder/Contractor must be prepared, if requested by the Commissioner, to present evidence of legal authority to do business in New York State, integrity, experience, ability, prior performance, organizational and financial capacity as well as where applicable, a statement as to supply, plant, machinery and capacity of the manufacturer or source for the production, distribution and servicing of the Product offered/Bid. If the Commissioner determines that the conditions and terms of the Bid Documents, Bid Specifications or Contract are not complied with, or that items, services or Product proposed to be furnished do not meet the specified requirements, or that the legal authority, integrity experience, ability, prior performance, organization and financial capacity or facilities are not satisfactory, the Commissioner may reject such Bid or terminate the Contract.

  • General Qualifications General qualifications commonly required of all candidates for, appointees to, and employees in the classified service such as integrity, honesty, sobriety, dependability, industry, thoroughness, accuracy, good judgment, initiative, resourcefulness, courtesy, ability to work cooperatively with others, good health, and freedom from disabling defects, shall be deemed to be a part of the personal characteristics of the minimum qualifications of each class specification and need not be specifically set forth therein. The Commission may prescribe alternative or additional qualifications for individual classes and such qualifications also shall be deemed to be a part of the specifications for such classes.

  • Vendor Qualifications Minimum Qualifications Based on the Contractor’s submission, OGS has determined that Contractor met the minimum qualifications for the lot(s) as identified in Appendix G, Contractor and OGS Information. If Contractor is awarded Lot 1 as a New York State Certified Minority- or Women- Owned Business Enterprise or as a New York State Small Business, Contractor agrees that it must retain at least one of such statuses to retain its Lot 1 award. Should a Contractor no longer retain at least one of such statuses, OGS shall suspend its Lot 1 award and the Contractor shall not be able to respond to Authorized User’s requests. If the Contractor fails to regain at least one of the statuses within 90 calendar days and provide OGS with documentation of such status, then its Lot 1 award shall be terminated. Any transaction awarded prior to Contractor’s loss of such statuses may continue until completion, unless otherwise terminated in accordance with this Contract. Lot 1– For projects up to $200,000 total Eligibility for this Lot is limited to the following:  Contractor is a New York State Certified Minority- or Women-Owned Business Enterprise; or  Contractor meets the definition of a New York State Small Business which is as follows: o A business which is resident in New York State, independently owned and operated, not dominant in its field and employs one hundred or less persons (see State Finance Law section 160(8)).

  • Staff Qualifications a) CONTRACTOR shall ensure that all individuals employed, contracted, and/or otherwise hired by CONTRACTOR to provide classroom and/or individualized instruction or related services hold a license, certificate, permit, or other document equivalent to that which staff in a public school are required to hold in the service rendered consistent with Education Code section 56366.1(n)(1) and are qualified pursuant to Title 5 of the California Code of Regulations sections 3064 and 3065.

  • Interstate Educational Personnel Contracts 1. The designated state official of a party state may make 1 or more contracts on behalf of his state with 1 or more other party states providing for the acceptance of educational personnel. Any such contract for the period of its duration shall be applicable to and binding on the states whose designated state officials enter into it, and the subdivisions of those states, with the same force and effect as if incorporated in this agreement. A designated state official may enter into a contract pursuant to this article only with states in which he finds that there are programs of education, certification standards or other acceptable qualifications that assure preparation or qualification of educational personnel on a basis sufficiently comparable, even though not identical to that prevailing in his own state.
