Health and Safety Committees. In order to provide a safe and healthful workplace, principal unit level LMC's shall establish Health and Safety Committees where they do not already exist and at the request of the Union. Each committee will be composed of an equal number of representatives appointed by the Union and the Employer and will be co-chaired by a Union and Employer representative. This committee may be combined with the Agency Labor/Management Committee upon mutual agreement of Agency Management and the Union. In each Agency that operates with institutions/geographic districts or regions, there shall be a Health and Safety Committee per institution/geographic district or region, unless otherwise mutually agreed upon. Unless mutually agreed otherwise each committee shall be composed of no more than three (3) representatives appointed by the Employer and three (3) employees appointed by the Union and shall be co-chaired by a Union and an Employer representative. Each facility operated by Agencies required to meet health and safety standards established by the Joint Commission on the Accreditation of Health Care Organizations (JCAHCO) or the Accreditations Council for Services for MRDD (AC MRDD) and/or the Medicaid/Medicare reimbursement programs shall have one (1) Health and Safety Committee. The committees shall be chaired by the Agency designee. In addition to the Health and Safety Committee membership required by the JCAHCO or the AC MRDD and/or Medicaid/Medicare, the Union shall appoint two (2) representatives to serve on the committee within thirty (30) days after the effective date of this Agreement. The general responsibility of all the committees will be to provide a safe and healthful workplace by recognizing hazards and recommending abatement of hazards and recommending education programs. To fulfill this responsibility the committees shall:

At CAPS request, each department shall establish at least one Joint CAPS/Management Health and Safety Committee. Additional Joint CAPS/Management Health and Safety Committees may be established as appropriate for the larger departments.
Health and Safety Committees. A. The State shall attempt to provide a safe and healthy work place for State employees. IUOE supports a positive and strong health and safety program and shall cooperate with the State's efforts in this regard.

The designated Local Union representative shall be allowed time off with pay to attend authorized committee meetings scheduled during his/her working hours. For purpose of pay only, properly designated Union representatives or alternates serving on these committees shall be permitted an equivalent amount of time off from their upcoming or previous shifts in accordance with Article 8, Section B. In the Departments of Education, Department of Health and Human Services, and Military and Veterans Affairs each Agency shall continue a Health and Safety Committee. This committee shall be appointed by the Agency Appointing Authority and shall include the Union's designated representative. The chairperson of the committee shall be appointed by the Agency Appointing Authority and shall be responsible for notifying the committee members of meetings, conducting the meetings, preparation and distribution of minutes,

Health and Safety Committees. In the following agencies, each institution having five (5) or more bargaining unit employees shall have a health and safety committee to recommend those actions and procedures necessary to insure that the Employer is in compliance with all appropriate health and safety rules and regulations: Ohio State School for the Blind Ohio School for the Deaf Department of Mental Health Department of Rehabilitation and Correction Department of Youth Services There shall also be a Health and Safety Committee for the State Library of Ohio. The Association shall appoint one (1) representative to serve on each committee. No agreement may be reached on any matter that would alter in any way the terms of this Agreement. The committees will meet and schedule a meeting at least once each calendar year and minutes of said meetings will be made available to employees. The committees will attempt to resolve issues raised. Such committees will be comprised of other bargaining representatives where applicable. Employees who are committee members will be paid base rate of pay for attendance at such meetings. In no event shall reimbursement exceed the employees' regular daily rate of pay. All meetings will be held during normal business hours.
