Excluded Charges. Edison will not be responsible for collecting on behalf of ESP any ESP Charges which do not appear on a Consolidated Xxxxxx Xxxx.
Excluded Charges. Except as set forth in this Master Contract, Contractor shall not charge FCSS for any time during which Contractor or its officers, employees, or subcontractors (to the extent FCSS has approved such subcontractors) are attending any professional development or training, take any types of leaves, attending staff meetings, setting up at a School Site, preparing instructional programs or activities for a School Site, or cleaning up at a School Site.

Excluded Charges. Edison will not be responsible for billing Direct Access Customers for ESP Charges which were previously billed other than by Edison, or for previously unbilled ESP Charges for ESP services furnished more than one (1) month prior to the date of the Consolidated Xxxxxx Xxxx. Any such ESP Charges shall be sent back to ESP with no further liability to Edison. Should any such ESP Charges appear on a Consolidated Xxxxxx Xxxx and be disputed by the Direct Access Customer, Edison may remove the charges from the Customer Xxxx and send them back to ESP with no further liability to Edison.
Excluded Charges. Vendor will not charge AOL for any Simultaneous Access that is used for signaling purposes. For any Simultaneous Access to which calls are blocked, Vendor will not charge AOL for such blocked Simultaneous Access beginning on the following day and continuing until the Simultaneous Access is no longer blocked. AOL will make daily test phone calls, at its discretion, to the Simultaneous Accesses provided to it by Vendor as part of the Services. If such test phone calls show that a certain number of Simultaneous Accesses were not available for use, even though Vendor's reports showed that they were available, then those Simultaneous Accesses shall be deemed blocked Simultaneous Accesses. Upon discovering a blocked Simultaneous Access, AOL shall raise a trouble ticket according to agreed procedures. Vendor will not charge Customer for such blocked Simultaneous Access from the beginning of the day following the day on which AOL discovered it was blocked, until the port is no longer blocked.
Excluded Charges. Any charges for less than full-time enrollment are expressly excluded from this agreement. Any such charges will be billed separately to the Participant/s and become payable to the University at the then-current rate at the time the charges are made. Also excluded from this agreement are tuition charges for courses that exceed full-time study.
Excluded Charges. Notwithstanding anything to the contrary contained in Paragraph 7.2(a), the following (collectively, the “Excluded Charges”) shall be excluded from the items set forth therein: (i) any costs and expenses paid or incurred by Landlord in discharging its obligations under the provisions of Paragraph 11.2 of the Lease; and (ii) in the event that Landlord, in its reasonable judgment, determines at any time during the term of this Lease that it is more appropriate and/or equitable that all or any portion of the charges set forth in Paragraph 7.2(a), whether for existing or additional items includible in Adjustments as provided in said Paragraph, be chargeable exclusively to the tenants or occupants of a particular building in the Project or to a particular tenant or group of tenants or occupants in the Project, such charges shall be excluded in determining the aggregate amount of the Adjustments a pro rata share of which Tenant is obligated to pay as provided in said Paragraph 7.2(a). In the event that any of the Excluded Charges are chargeable to Tenant, either by reason of the Premises being located in the particular building to which such Excluded Charges relate, or by reason of the fact that such Excluded Charges relate to Tenant or a group of tenants and occupants which includes Tenant, commencing with the first (1st) calendar month following the calendar month in which Landlord gives Tenant written notice of the amount of such Excluded Charges and Tenant’s share thereof in accordance with Paragraph 7.2(d), Tenant shall be obligated to pay a share of such Excluded Charges calculated as follows:
Excluded Charges. No credit is granted for any Excluded Charges, as set out above, which are payable per separate payment and invoice terms.
Excluded Charges. 1. The amounts due and payable to LORAL are exclusive of all federal, provincial, state and municipal taxes, fees, contributions and other charges directly related to the Service provided by LORAL. XXXXXXX shall be responsible for the payment of any such taxes, fees, contributions and for other charges imposed by any Governmental Entity in Canada or in the U.S.A. with respect to the Service or charges payable by XXXXXXX under the Agreement.
Excluded Charges. For the purposes of determining compliance with the covenants set forth in Sections 6.25 and 6.26 (as renumbered above) of the Agreement (but not for the purposes of the definition of "Applicable Margin") for the fiscal quarters ending on December 31, 2000, March 31, 2001, June 30, 2001 and September 30, 2001 (but not thereafter), EBITDA shall be calculated without taking into account an aggregate of One Million Dollars ($1,000,000) (but no more) of charges recorded in the fiscal quarter ended December 31, 2000.
