Common use of Contractual Relationship Clause in Contracts

Contractual Relationship. The parties acknowledge and agree that, by executing the Agreement, Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, thereby establishing a separate DPA between FF and each such Authorized Affiliate subject to the provisions of the Agreement, this Clause 9, and Clause 10 below. Each Authorized Affiliate agrees to be bound by the obligations under this DPA and, to the extent applicable, the Agreement. For the avoidance of doubt, an Authorized Affiliate is not and does not become a party to the Agreement, and is only a party to the DPA. All access to and use of the Services by Authorized Affiliates must comply with the terms and conditions of the Agreement, and any violation of the terms and conditions of the Agreement by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The parties acknowledge and agree that, by executing the AgreementDPA, the Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized AffiliatesAffiliate(s), thereby establishing a separate DPA between FF Xxxxxxxx and each such Authorized Affiliate subject to the provisions of the Agreement, Agreement and this Clause 9, and Clause 10 below15 of this DPA. Each Authorized Affiliate agrees to be bound by the obligations under this DPA and, to the extent applicable, the Agreement. For the avoidance of doubt, an Authorized Affiliate is not and does not become a party to the Agreement, and is only a party to the DPA. All access to and use of the Services and Content by Authorized Affiliates Affiliate(s) must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized Affiliate shall be deemed a violation by Customer.

The parties acknowledge and agree that, by executing the AgreementDPA in accordance with “How to execute this DPA”, Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Controller Affiliates, thereby establishing a separate DPA between FF Red Guava and each such Authorized Controller Affiliate subject to the provisions of the Agreement, Agreement and this Clause Section 8 and Section 9, and Clause 10 below. Each Authorized Controller Affiliate agrees to be bound by the obligations under this DPA and, to the extent applicable, the Agreement. For the avoidance of doubt, an Authorized a Controller Affiliate is not and does not become a party to the Agreement, and is only a party to the DPA. All access to and use of the Services by Authorized Controller Affiliates must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized a Controller Affiliate shall be deemed a violation by Customer.

Each Authorized Affiliate agrees to be bound by the obligations under this DPA and, to the extent applicable, the Agreement. For the avoidance of doubt, by Customer entering into this DPA, an Authorized Affiliate is not and does not become a party to the Agreement, and is only a party to the DPA. All access to and use of the Services and Content by Authorized Affiliates must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized Affiliate shall be deemed a violation by Customer.

Each Authorized Controller Affiliate agrees to be bound by the obligations under this DPA and, to the extent applicable, the Agreement. For the avoidance of doubt, an Authorized a Controller Affiliate is not and does not become a party to the Agreement, and is only a party to the DPA. All access to and use of the Services by Authorized Controller Affiliates must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized a Controller Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The parties acknowledge and agree that, by executing the Agreement, Customer XXX enters into the Int. DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, thereby establishing a separate Int. DPA between FF ClassDojo and each such Authorized Affiliate subject to the provisions of the Agreement, Agreement and this Clause 9, Section 9 and Clause 10 belowSection 10. Each Authorized Affiliate agrees to be bound by the obligations under this Int. DPA and, to the extent applicable, the Agreement. For the avoidance of doubt, an Authorized Affiliate is not and does not become a party to the Agreement, Agreement and is only a party to the Int. DPA. All access to and use of the Services and Content by Authorized Affiliates must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized Affiliate shall be deemed a violation by CustomerXXX.

Contractual Relationship. All access to to, and use of of, the Services and content by Authorized Affiliates must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized Affiliate shall be deemed a violation by CustomerClient.

Each Authorized Controller Affiliate agrees to be bound by the obligations under this DPA and, to the extent applicable, the Agreement. For the avoidance of doubt, an Authorized a Controller Affiliate is not and does not become a party to the Agreement, Agreement and is only a party to the DPA. All access to and use of the Services by Authorized Controller Affiliates must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized a Controller Affiliate shall be deemed a violation by CustomerClient.

Contractual Relationship. The parties Parties acknowledge and agree that, by executing entering into the AgreementTerms of Service, Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Affiliates, thereby establishing a separate DPA between FF Devolutions and each such Authorized Affiliate subject to the provisions of the Agreement, Agreement and this Clause 9, Section 7 and Clause 10 belowSection 8. Each Authorized Affiliate agrees to be bound by the obligations under this DPA and, to the extent applicable, the AgreementTerms of Service. For the avoidance of doubt, an Authorized Affiliate is not and does not become a party to the Agreement, Terms of Service and is only a party to the DPA. All access to and use of the Services by Authorized Affiliates must comply with the terms and conditions of the Agreement, Terms of Service and any violation of the terms and conditions of the Agreement Terms of Service by an Authorized Affiliate shall be deemed a violation by Customer.

Contractual Relationship. The parties acknowledge and agree that, by executing the AgreementDPA in accordance with “Instructions” section above, Customer enters into the DPA on behalf of itself and, as applicable, in the name and on behalf of its Authorized Controller Affiliates, thereby establishing a separate DPA between FF Asana and each such Authorized Controller Affiliate subject to the provisions of the Agreement, Agreement and this Clause Section 8 and Section 9, and Clause 10 below. Each Authorized Controller Affiliate agrees to be bound by the obligations under this DPA and, to the extent applicable, the Agreement. For the avoidance of doubt, an Authorized a Controller Affiliate is not and does not become a party to the Agreement, and is only a party to the DPA. All access to and use of the Services Service by Authorized Controller Affiliates must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized a Controller Affiliate shall be deemed a violation by Customer.

All access to and use of the Services and Content by Authorized Affiliates Affiliate(s) must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized Affiliate shall be deemed a violation by Customer.

All access to and use of the Services by Authorized Controller Affiliates must comply with the terms and conditions of the Agreement, Agreement and any violation of the terms and conditions of the Agreement by an Authorized a Controller Affiliate shall be deemed a violation by Customer.
