Common use of CONSTRUCTION OF THE PROJECT/ APARTMENT Clause in Contracts

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject . Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and local authority [Please insert the relevant State laws] and shall not have an option to make any variation/alteration/variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. Bhoomi Vikas Niyam 2012, MP Municipal Corporation Act, 1993and 1956 and shall not have an option to make any variation/alteration/variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plansplan, floor plans plan and specifications, amenities and facilities, facilities subject however to the terms in this Agreement, the Promoter/Developer . The Promoter undertakes to strictly abide by such the plans approved and as may be approved as per the provisions contained herein by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and Rajpur-Sonarpur Municipality Building Rules and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, Act and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and Bhumi Vikas Niyam and Nagar Tatha Gram Nivesh Adhiniyam and shall not have an option to make any variation/alteration/variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. Act XXII of 1993 ] and shall not have an option to make any variation/alteration/variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and Housing Industries Regulation Act ,2017 (West Bengal Act XLI of 2017) and shall not have an option to make any variation/alterationvariation /alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allotteehas seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and 1993 and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer shall Developershall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density 12 norms and provisions prescribed by the West Bengal Municipal Act, 1993and 1993 and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Purchaser has seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, payment plan and the specificationsspecification, amenities and facilities [annexed along with as stated in this Agreement which has been approved by the competent authority, as represented by the Vendors/Owners/Promoter/Developer. The Promoter/Promoter/ Developer shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR FAR, and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and 2006 and shall not have an option to make any variation/alteration/variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by tie the Promoter/Developer shall constitute a material breach of the this Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment Apartment/ Flat and accepted the floor plan, payment plan and the specificationsspecification, amenities and facilities [annexed along with this Agreement as mentioned in the Scheedule which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal (Formerly Rajarht-Gopalpur Municipality) presently Bidhannagar Municipal Act, 1993and Corporation and shall not have an option to make any variation/alterationvariation /alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement as per SCHEDULE ‘D’ and SCHEDULE ‘E’ hereunder, which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal ActXxxxxxxxx Xxx, 1993and 0000 and shall not have an option to make any variation/alterationvariation /alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Allotted Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement (stated in Part – I and Part – II of the Third Schedule hereunder written) which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plansplan, floor plans and plan, specifications, amenities and facilities, facilities subject to the terms in this Agreement, the Promoter/Developer . The Promoter undertakes to strictly abide by such plans approved by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Kolkata Municipal Act, 1993and Corporation Building Rules and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment [Apartment/Plot] and accepted the floor plan, payment plan and the specificationsspecification, amenities and facilities [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans plan approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and 1993, West Bengal Municipal (Building) Rules, 1996 shall not have an option to make any variation/alteration/variation / alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.. The PromoterVENDOR/Developer DEVELOPER shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the PromoterVENDOR/Developer DEVELOPER undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and Housing Industries Regulation Act ,2017 (West Bengal Act XLI of 2017 and shall not have an option to make any variation/alterationvariation /alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoterthe VENDOR/Developer DEVELOPER shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and Bhumi Xxxxx Xxxxx and Nagar Tatha Gram Nivesh Adhiniyam and shall not have an option to make any variation/alteration/variation / alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Designated Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with as per relevant Schedules to this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specificationsfacilities, amenities and facilitiesspecifications, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR (Floor Area Ratio) and density norms and provisions prescribed by the West Bengal Kolkata Municipal Act, 1993and Corporation Building Rules and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the persisting State Laws in West Bengal Municipal Acti.e. Xxx Xxxxxxxxx Xxxxxxxxx Xxx, 1993and 0000 and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under the this Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment said unit/apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Xxxxxxxxx Xxx, 0000 read with West Bengal Municipal ActBuilding Rules, 1993and 2007 and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under the Actsaid Act and Rules, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

The Promoter/Developer shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR FAR, and density norms and provisions prescribed by the West Bengal Municipal ActXxxxxxxxx Xxx, 1993and 0000 and shall not have an option to make any variation/alteration/variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by tie the Promoter/Developer shall constitute a material breach of the this Agreement.

The Promoter/Developer shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR FAR, and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and 2006 and shall not have an option to make any variation/alteration/variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by tie the Promoter/Developer shall constitute a material breach of the this Agreement.

The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specificationsspecificati ons, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-lawsbye -laws, FAR and density norms and provisions prescribed prescri bed by the West Bengal Municipal Corporation Act, 1993and 2006 [Please insert the relevant State laws] and shall not have an option to make any variation/alteration/variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term t erm by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities amenities, and facilities of the Apartment [Apartment] and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the South 24 Parganas Xxxxx Xxxxxxx, West Bengal Municipal ActThe South 24 Parganas Revised General Bye-Law, 1993and 2014 and shall not have an option to make any variation/alteration/variation / alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-bye- laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act(Building) Rules, 1993and 2007 [Please insert the relevant State laws] and shall not have an option to make any variation/alterationvariation /alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the persisting State Laws in West Bengal Municipal i.e. The Apartment Ownership Act, 1993and 1972 and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under the this Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. (i) The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities Amenities and facilities of the Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Corporation Act, 1993and 2006 [Please insert the relevant State laws] and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen and accepted the proposed layout plan, floor plan of the Apartment as also shown in Annexure-B to the Agreement and specifications, amenities and facilities of the Apartment Apartment/Project as mentioned in the SCHEDULE-4 hereto and have accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement same which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Kolkata Municipal Corporation Act, 1993and 1980 and shall not have an option to make any variation/alterationvariation /alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, payment plan Payment Plan and the specificationsspecification, amenities and facilities [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specificationsplans, specification, amenities and facilities, subject . Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal ActPlanning and Building Standards Regulations of concerned local planning authority - Odisha Development Authorities (Planning and Building Standards) Rules, 1993and 2020 and shall not have an option to make any variation/alteration/variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the (Apartment / Plot) and accepted the floor plan, payment plan and the specifications, amenities and facilities [(annexed along with this Agreement Agreement) which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Kolkata Municipal ActCorporation, 1993and Kolkata (please insert the relevant State laws) and shall not have an option to make any variation/variation / alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The AllotteePurchaser/s have Allotte has seen the proposed layout plan, sanctioned and revised plans, specifications, amenities and facilities of the Apartment said flat/apartment and accepted the floor plan, payment plan and the specifications, specifications amenities and facilities [annexed along with as mentioned in this Agreement agreement hereinafter which has been approved by the competent authority, as represented represents by the Developer/Promoter/Developer. The PromoterDeveloper/Developer Promoter shall develop the Project project in accordance with the said sanctioned, revised and layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter. The Developer/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Kolkata Municipal Act, 1993and Corporation and shall not have an option to make take any variation/alteration/variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoterthe Developer/Developer Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities specifications of the Apartment Unit and accepted the floor planPayment Plan, payment plan and the specificationsplans, amenities and facilities layout plans [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Allottee has also understood that the building in which the Unit is situated forms part of the second phase of development. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject . Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and any modifications to be hereafter approved by the authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal ActThe New Town Kolkata (Building) Rules, 1993and 2014and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen and accepted the proposed layout plan, plan of the Apartment and floor plan of the Unit as also shown in Annexure-B to the Agreement and specifications, amenities and facilities of the Apartment Apartment/Project as mentioned in the SCHEDULE-4 hereto and have accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement same which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Kolkata Municipal Corporation Act, 1993and 1980 and shall not have an option to make any variation/alteration/modification variation /alteration /modification in such plans, plans or other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The AllotteeAllottee(s) has/s have seen the sanctioned plan which has been approved by Kolkata Municipal Corporation, as represented by the Promoter, proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the said sanctioned plan, floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement which has been approved by the competent authority, as represented by the Promoter/Developermentioned herein. The Promoter/Developer Promoter shall develop the Project in accordance with the said sanctioned plan, layout plans, floor plans and specifications, amenities and facilities, subject . Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans which shall be approved by the competent Authorities authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and such authorities and shall not have an option to make any variation/alteration/modification in such plans, other than as agreed upon or in the manner provided under the Actapplicable laws, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities facili- ties of the Designated Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with as per relevant Schedules to this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/DeveloperPro- moter. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specificationsfacilities, amenities and facilitiesspecifications, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Kolkata Municipal Act, 1993and Corporation Build- ing Rules and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under the this Agreement and the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities specifications of the Apartment Unit and accepted the floor planPayment Plan, payment plan and the specifications, amenities and facilities [annexed plans,[annexed along with this Agreement Agreement] layout plans which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Allottee has also understood that the building in which the Unit is situated forms part of the one amongst other phases of development as recited above. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject specifications as mentioned in PART-IX of Schedule A hereto. Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and any modifications to be hereafter approved by the authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act(Building) Rules, 1993and 2007 & The West Bengal Municipal Act 1993 and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities amenities, and facilities of the Apartment [Apartment] and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal ActNew Kolkata Development Authority (NKDA) The New Town Kolkata (Building) Rules, 1993and 2009 [Please insert the relevant State laws] and shall not have an option to make any variation/alteration/variation / alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment [Apartment/Flat / Apartment] and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject . Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and Town and Country Planning Indore [Please insert the relevant State laws]and shall not have an option to make any variation/alteration/variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities specifications of the Apartment Unit and accepted the floor planPayment Plan, payment plan and the specificationsplans, amenities and facilities layout plans [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Allottee has also understood that the building in which the Unit is situated forms part of the first phase of development. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject . Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act(Building) Rules, 1993and 2007 & The West Bengal Municipal Act 1993 and shall not have an option to make any variation/alteration/modification in such plans, other than in the manner provided under this Agreement and the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment Apartment/ Shop/Showroom/Office and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement Agreement] which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject . Subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and Bhumi Vikas Niyam and Nagar Tatha Gram Nivesh Adhiniyam and shall not have an option to make any variation/alteration/variation / alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/ APARTMENT. The Allottee/s have Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement as per SCHEDULE ‘D’ and SCHEDULE ‘E’ hereunder, which has been approved by the competent authority, as represented by the Promoter/Developer. The Promoter/Developer Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject to the terms in this Agreement, the Promoter/Developer Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the West Bengal Municipal Act, 1993and 1993 and shall not have an option to make any variation/alterationvariation /alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by tie Promoter/Developer the Promoter shall constitute a material breach of the Agreement.
