BUYER'S FACILITIES. 1. Buyer will maintain at its own expense facilities from the delivery point to the point of use and the burners and equipment for using gas, and Buyer will at all times keep gas-using equipment on said premises in a condition conforming with such reasonable rules and regulations as may be prescribed therefore by regulatory authority having jurisdiction thereover and with the requirements of any valid law thereto appertaining. In the event that rules are not prescribed by a regulatory authority, Buyer will abide by codes as used in the gas industry.

The gas delivered by Seller will be gathered into gathering system(s) and may be redelivered to a processing plant or plants for the removal of NGL’s together with gas produced from other properties. The gathering system(s) and plant or plants, or successor facilities, are defined as “Buyer’s Facilities” whether owned by Buyer, an affiliate of Buyer, or an unaffiliated third party. No facilities downstream of the processing plant or plants are included in “Buyer’s Facilities.”

The gathering systems and plant or plants, or successor facilities, are “Buyer’s Facilities” whether owned by Buyer, an Affiliate of Buyer, or an unaffiliated third party. No facilities downstream of the processing plant or plants other than short connecting lines to transmission lines are included in “Buyer’s Facilities.” (d) Day – a period of 24 consecutive hours beginning and ending at 9:00 a.m. local time, or other 24 hour period designated by Buyer and a downstream pipeline. BUYER'S FACILITIES. For CGD entities: the City Gate Station and City Gas Distribution network including all equipment installed by Buyer in the Authorised Area for City Gas Distribution. • For aggregators / resellers: the Gas receiving, and handling facilities located at , at which the pipeline connects with the downstream transporter. • For other Buyers: The Gas receiving, and handling facilities located at , at which the Gas sold under this Agreement is to be consumed Both parties are obligated to operate their respective facilities in accordance with the standard of a reasonable and prudent operator. Buyer will be obligated to ensure that gas transporter also operates its facilities in accordance with the standard of a reasonable and prudent operator. 13 Take or Pay/Supply or Pay Take or Pay Daily volume (DCQ) quantity allocated to each successful bidder during the contract tenure will be under 100% take or pay.
