Common use of Alternative Employment Clause in Contracts

Alternative Employment. The Company, in a particular redundancy case, may make application to the AIRC to have the general severance pay prescription varied if the Company obtains acceptable alternative employment for an employee. Such application may only be made under this Part if it has actual application to an employee and the application would be dealt with under the dispute settlement procedure. This provision does not apply in circumstances involving transmission of business as set in 7.3, above.
