All references in the Deeds of Trust and all other references in the Loan Documents to the “Loan” shall mean the Loan, as amended by this Agreement and the Short Form Agreements.
In the event Contractor breaches any of the terms and conditions of this Agreement after notice and an opportunity to cure as provided in Exhibit E herein, the Contractor will be in default of the terms and conditions of this Agreement as well as the Notes, and the County may demand immediate and full payment of the principal amount of the Notes and any accrued interest, and/or may initiate foreclosure proceedings under the Deeds of Trust.
Borrower shall, at its expense, comply with all of the insurance requirements set forth in this Agreement and the Mortgages and Deeds of Trust, throughout the term of the Loan.
Each of the Deeds of Trust is being amended upon the Effective Date pursuant to the applicable Short Form Agreements, each of which is incorporated herein.
The funds may be disbursed in accordance with the escrow instructions when the Deeds of Trust can be recorded and CLTA Policies of Title Insurance can be issued to the County in the amount equal to the face value of the notes.
