Existing street trees that are determined by the CITY to be dead, dying or severely damaged due to construction activity within three years after acceptance of the public Improvements or granting of Certificate of Occupancy for the final unit, shall be replaced by the DEVELOPER as provided by Chapter 57 of the Xxx Arbor City Code.
