Replacements and Repairs Other than Required Replacements or Required Repairs.
Borrower hereby grants to Lender an irrevocable power-of-attorney, coupled with an interest, to perform upon the occurrence and during the continuance of an Event of Default any of the Required Repairs as required above and to apply the amounts on deposit in the Required Repair Reserve Account to the costs associated therewith, all as Lender may determine in its sole discretion but without obligation to do so.
The Contract shall remain in full force and effect if, within five (5) days of Purchaser’s receipt of Seller’s notice of termination, Purchaser elects, in writing, to pay the cost of the Required Repairs which exceeds the Repair Amount.
Borrower shall perform the work for the Required Repairs diligently and continuously, and shall complete the Required Repairs in a good and workmanlike manner on or before the date that is the applicable “Outside Completion Date” set forth on Exhibit 5.20 attached hereto, in accordance with all Applicable Laws and in a manner reasonably acceptable to Lender.
The Seller’s advisory now contains revisions to Paragraph D, “Government Required Repairs, Replacements and Alterations,” which includes instructions regarding smoke alarms and brace water heaters.
