Relief Event definition

Relief Event has the meaning set forth in Section 3.12.
Relief Event means any of the following events or circumstances if and to the extent it interferes adversely with, or causes a failure of, the carrying out of the Design, the Construction or the Services or causes an Unavailability Event:

Examples of Relief Event in a sentence

  • Developer shall have no claim for a Relief Event, Extended Relief Event or Compensation Event by reason of TxDOT’s grant of access permits, the terms and conditions thereof, or the actions of permit holders or their employees, agents, representatives and invitees.

  • If approval is subject to the sole, absolute or unfettered discretion of TxDOT, then its decision shall be final, binding and not subject to dispute resolution, and such decision shall not constitute a TxDOT-Caused Delay, TxDOT Change, Relief Event, Compensation Event or other basis for any Claim.

  • Schedule delays resulting from inadequate or incomplete submissions of Acquisition Packages shall be the responsibility of Developer and will not be eligible for treatment as a Relief Event or Compensation Event.


More Definitions of Relief Event

Relief Event means any of the following events that prevents, delays, interrupts or renders more expensive to the Contractor the performance of any obligation of the Contractor under this Agreement:

Relief Event means: (a) fire, explosion, lightning, xxxxx, xxxxxxx, flood, bursting or overflowing of water tanks, apparatus or pipes, ionising radiation (to the extent it does not constitute a Force Majeure Event) and earthquakes; (b) riot, acts of concerted indiscipline, public disorder and/or civil commotion, provided that the Contractor: (i) has not, by its acts or omissions caused or contributed to such riot, acts of concerted indiscipline, public disorder and/or civil commotion: (aa) unless such acts or omissions are in accordance with the provision of the Services in accordance with this Contract; or (bb) except to the extent that the Contractor is acting on the written instruction of the Authority; (c) failure by any statutory undertaker, utility company, local authority or other like body to carry out works or provide services; (d) any accidental loss or damage to the Authority's Premises or any roads servicing them; (e) any failure or shortage of power, fuel or transport; (f) any blockade or embargo which does not constitute a Force Majeure Event; (g) any: (i) official or unofficial strike; (ii) lockout; (iii) go-slow; or (iv) other dispute generally affecting the criminal justice services industry or a significant sector of any of it; (h) exceptionally adverse weather conditions; (i) human pandemic unless any of the events listed in paragraphs (a) to (i) of this definition (inclusive) arises (directly or indirectly) as a result of a breach by the Contractor of its obligations under this Contract, the Contractor's negligence or any wilful default or wilful act of the Contractor or any Contractor Related Party;
Relief Event means any breach by the Client of its obligations under the Conditions or an Order, including any of the Clients Responsibilities (and this definition shall include a breach of such obligations by a third Party performing such obligations on behalf of the Client);
