With the introduction of the Malaysian Personal Data Protection Act 2010 ("PDPA"), we are even committed to ensure the privacy and confidentiality and security of all personal data are protected in line with the PDPA.
The processing of your Personal Data is carried out in accordance with the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016), as well as in compliance with French legislation governing the protection of personal data and privacy in electronic communications, notably the French Data Protection Act (amended on 20 June 2018 to enhance personal data protection).
Both parties undertake to comply with the Data Protection Act 1998 ("Act") (and any regulations made under the Act) and any relevant security codes and shall procure that its employees, agents and subcontractors shall observe the provisions of the Act (as applicable).
For purposes of this Agreement, Sensitive Data is data that requires special protection by law or regulation, such as data that is subject to data privacy or data protection laws or regulations, is classified government information, directly or indirectly identifies an individual, is or contains personal health information, or is subject to PCI, the Gramm Xxxxx Xxxxxx Act, HIPAA, CCPA, the UK Data Protection Act 2018, or the GDPR.
For the purposes of the applicable Data Protection Act, Paynovate shall be considered a "data controller" with respect to any processing of personal data related to Payment Transactions in connection with the Payment Transactions governed by the Merchant Agreement.
