Cold call marketing is defined as any unsolicited personal contact by the MCO with a potential member for the purpose of marketing. Cold call. Marketing means any unsolicited personal contact by MCO personnel with the Eligible Enrollee at that individual's residence for the purpose of influencing the individual to enroll with that MCO and includes unsolicited telephone contact and any other type of contact made without the individual's written consent. Such written consent may be obtained at the initiation of a visit to an individual's residence as long as the Contractor has obtained the individual's oral consent prior to the visit and has documented such consent in a written form that identifies the person granting the consent and the person receiving the consent, as well as the date, time and place that the oral consent was given. Any contacts at the individual's residence must be made within thirty (30) days from the date the individual gave oral consent. Soliciting individuals to provide the names of other Eligible Enrollees is also strictly prohibited. Nothing in this section shall prohibit the Contractor from distributing unsolicited Marketing materials via the United States Postal Service or a commercial delivery service where such service is unrelated to the Contractor.
