City Approvals definition

City Approvals is defined in Recital D.

City Approvals has the meaning provided in the 14th Recital of this Agreement. "City Council" has the meaning provided in the 3rd Recital of this Agreement.

City Approvals means, collectively, zoning approvals, conditional use permit(s) or variances and any other discretionary approvals required for construction of the Development. For definitional purposes in this Agreement, "City Approvals" do not include the Building Permit(s), or other ministerial permits.

Examples of City Approvals in a sentence

• The Parties, however, acknowledge that the City’s approval of this Agreement and the City Approvals are legislative actions subject to referendum.

• In acting upon any Subsequent City Approvals, City’s exercise of discretion and permit authority shall conform to this Agreement.

• Failure to indemnify City, when required by this Agreement, shall constitute a material breach of this Agreement and of any applicable Conditional Use Permit and Subsequent City Approvals, which shall entitle City to all remedies available under law, including, but not limited to, specific performance and damages.

• Notwithstanding the foregoing, in the course of taking action on the Subsequent City Approvals, City will exercise discretion in adopting mitigation measures as part of the Conditional Use Permit.

More Definitions of City Approvals

City Approvals is defined in Section 2.2.

City Approvals means the City permits and approvals for the Project, the Subdivision Map, and the Subdivision Agreement, as these permits and approvals may be amended from time to time.

City Approvals means, collectively, the zoning amendment and any other land use approvals required by the City prior to the Developer being authorized to construct the Minimum Improvements.

City Approvals has the meaning set forth in Section 5.8.

City Approvals means Aany permit or approval required by the City prior to any construction activity, including, but not limited to, site preparation, grading, excavation or construction.

City Approvals means the final adoption and effectiveness of one or more ordinances and/or resolutions of the Common Council of the City of Evansville and the EEDC, authorizing or approving the issuance of TIF Bonds and the EEDC Loans, approving the Tax Phase-in, and any other matters necessary for the EEDC, ERC, DMD or the City to undertake each of their respective obligations under this Agreement.

City Approvals means those certain land use entitlement approvals concerning the Property and the Project that have been granted by the City, including, without limitation, approvals for the Applications, the Sketch PUD, the Preliminary PUD, the Final PUD and the Site Development Permit.
