Catastrophic disability means a physical and not a psychological condition that the local board determines prevents the employee from totally and permanently engaging in any gainful employment and that results from a physical injury incurred in the performance of the employee's duty.

Catastrophic disability means that a company may use a Definition or Concept of Catastrophic Disability that always pays a monthly periodic income benefit amount in addition to any other Disability benefit amounts, subject to satisfaction of all policy terms and conditions by the insured. Instead of a monthly periodic income benefit amount, the company may pay a single “lump sum” benefit amount of no less than $1,000 for Catastrophic Disability. The definition/concept of Catastrophic Disability shall be triggered by an inability of the insured to perform, due to Injury or Sickness, a maximum (the company may reduce the number to one, but cannot raise it above two) of two Activities of Daily Living (ADLs). The definition/concept shall also be triggered by the Cognitive Impairment of the insured. Catastrophic Disability benefits may have separate Elimination Periods and separate Benefit Periods apart from other Disability benefits of the policy, or Catastrophic Disability benefits may use the same Elimination Periods or same Benefit Periods used for other Disability benefits of the policy. Regardless of the Elimination Period designs of the policy, the Elimination Period shall not be longer than one (1) year if the insured meets the policy triggers for two (2) or more types of Disability, one of which is Catastrophic Disability, subject to satisfaction of all policy terms and conditions by the insured. Regardless of the Benefit Period designs of the policy, an insured shall be guaranteed a minimum of one (1) year of Catastrophic Disability benefit payments (the one year period of Disability benefit payments shall exclude any time devoted to satisfaction of Elimination Periods), subject to satisfaction of all policy terms and conditions by the insured. The company may add other triggers, such as loss of two arms or two legs, as long as they are properly described in the policy. Catastrophic Disability benefits shall only be directly related to income losses of the insured on account of Catastrophic Disability due to Injury or Sickness. Catastrophic Disability benefits shall not directly or indirectly provide any coverage for long term care services, and shall contain a prominent disclosure of this fact.
