Stormwater Drainage. Other than the Stormwater Drainage, culverts, piping, connections and/or other related improvements that are located within the Xxxxx Street Extension R.O.W., in accordance with· Section 6.06 of this MOU Amendment, Owner shall construct onsite and off-site drainage improvements to convey storm water from the Land and accommodate natural flows from adjacent properties to the Colorado River in compliance with any applicable State or Federal law related to storm water drainage and discharge (the “Drainage Improvements”). City shall not require Owner to construct on-site detention on any portion of the Land within the natural drainage area of the Land. If necessary, any off-site stormwater easements shall be obtained by the Owner with assistance from the City. The Drainage Improvements may include excess capacity above and beyond (i) what is necessary to serve the Land and (ii) any existing or natural flow from adjacent properties. After the Drainage Improvements are constructed, Owner shall be solely responsible for negotiating agreements with adjacent property owner(s) who desire to use any excess capacity (if available) of the Drainage Improvements. Owner’s engineer shall notify City engineer of the amount of flow discharge to the Drainage Improvements as agreed to by Owner and any adjacent property owner. City shall have no role in these negotiations or agreements. All such agreements shall be filed by Owner in the Bastrop County Records.
Stormwater Drainage. It is anticipated that all stormwater flows generated by the development of the Project will generally follow the Property’s existing natural drainage and that Developer or Community Home Owners Association(s) will be responsible for the maintenance of any related drainage facilities to the extent located within the Property. Additional stormwater infrastructure, inside or adjacent to the Project boundaries, may be required by the City Engineer, upon review and analysis of the preliminary or final site plan. Builder/Sub-developer Completion of Developer’s Infrastructure Improvements; Bonding by Builder/Sub-developer. Developer may offer, for sale or lease, Parcels to builders or Sub-developers in a phased manner. Developer may enter into different types of transactions, including but not limited to, sales, development leases, or ground leases. As a condition of such transactions, Developer may contractually obligate the builder or Sub-developer to install, complete, and dedicate all or any portion of any of the Developer’s Infrastructure Improvements. Such builders or Sub-developers shall not be permitted to further assign such obligations. The City may require of such builders or Sub-developers a bond or any other financial assurance allowed by its ordinances for any Developer’s Infrastructure Improvements. At such time as the City receives and accepts such financial assurance, Developer’s obligation shall terminate with respect to such Developer’s Infrastructure Improvements. Developer and any Builder/Sub-developer may obtain building permits and/or temporary Certificates of Occupancy for model homes, home shows, sales offices, construction trailers or similar temporary uses in accordance with Utah Code Xxx. § 10-9a-802(2)(d) (2022).

Stormwater Drainage. A stormwater drain may be situated beneath the Land, and may form part of an inter- allotment stormwater drainage system. If so, the roof water drainage must be connected to the connection point provided by the Seller contained within the Land. If not, the Land must be sloped or graded so that all stormwater run off is drained or directed towards the road/s adjacent to the Land. If the Land has been cut or filled prior to construction of a dwelling, the cutting and filling must be carried out so that the dwelling pad is sloped or graded to ensure that all stormwater run off is drained or directed from the fill area to the cut area, and then drained or directed towards the inter-allotment drainage pit (if any) or the road/s adjacent to the Land at grades exceeding 1 in 100 (1%).
