NETWORK RAIL. If, at the time appointed for a general meeting as referred to in clause 5.3, Network Rail is not present by proxy or by a duly authorised representative, the general meeting shall be adjourned to such time and place as the chairman of the meeting shall determine and which shall be notified to all Members. Network Rail shall use all reasonable endeavours to procure that it is present by proxy or by a duly authorised representative at the time and place appointed for every general meeting of the Members.
NETWORK RAIL. 4.1 The BBS Consortium will work with tie to achieve an acceptable position in relation to the flowdown of obligations contained in the Network Rail Asset Protection Agreement based on tie's drafting position.
NETWORK RAIL. BEAR Scotland will, in discussion with Network Rail, ensure that appropriate safety precautions are taken when snow ploughing vehicles are negotiating railway level crossings.
NETWORK RAIL. (High Speed) shall take reasonable steps to notify the Supplier of a request for Confidential Information (in accordance with the Secretary of State’s section 45 Code of Practice on the Discharge of the Functions of Public Authorities under Part 1 of the Freedom of Information Act 2000) to the extent that it is permissible and reasonably practical for it to do so and shall consider any reasonable and timely representations made by the Supplier regarding the application of exemptions to the requested information.
NETWORK RAIL. There are no railway crossings on the North East Unit, however on a daily basis the BEAR Scotland daily winter action plan will be submitted to Network Rail.
