Marketing Standards. To protect the reputation and strength of the Trademarks and the goodwill associated with each Trademark, Constellation Beers shall: (a) always use the Trademarks in connection with the marketing and sale of Importer Products and Interim Products, and other activities with respect to the Trademarks, in a manner reasonably consistent with the requirements with respect to form, color, style and appearance of the applicable Brand Guidelines (and Constellation Beers shall reasonably consider and take into account the goodwill associated with the Trademarks in making any material changes to the other aspects of the Brand Guidelines such as strategic marketing), and (b) use and/or reproduce the Trademarks in accordance with all applicable laws, rules, and regulations. Further, Constellation Beers shall not do any willful or intentional act which would damage the image of the Products in the Territory, and shall refrain from taking any act which disparages, discredits, dishonors, reflects adversely upon, or in any other manner materially xxxxx the Trademarks, or the goodwill associated therewith. Additionally, with respect to Importer Products and Interim Products, Constellation Beers shall comply with the Advertising and Marketing Code of the Beer Institute, as it may be amended from time to time.

Marketing Standards. PSC agrees to develop and implement marketing and promotional plans consistent with a state park, regional park, or community center, or adventure park. Should PSC choose to operate Lift 4, said promotional plans should also be consistent with ski areas of similar size and/or operating structures.
Marketing Standards. At all times, Reseller shall conduct its business in a manner that reflects favorably on Agtools and Agtools’ good name, goodwill and reputation. Reseller shall ensure that its employees and agents maintain the highest level of market standard, of integrity and professionalism in advertising Agtools Services.
Marketing Standards. LICENSEE acknowledges familiarity with the purposes and high standards of conduct adopted by the NCAA as set forth in its constitution, and agrees to observe same at all times in the promoting and selling of articles of merchandise bearing the NCAA name. In order to maintain the NCAA's identity with intercollegiate athletics, LICENSEE agrees that all literature, labels, artwork, displays, advertising and promotional materials and activities pertaining to articles of merchandise bearing the NCAA name shall be separate and distinct from any similar materials used or activities engaged in by LICENSEE relating to professional athletics.
Marketing Standards. The MCO may conduct general advertising that does not specifically solicit the Medicaid population. Member enrollment will be handled by the Department through a Contract with a central enrollment broker. The MCO must submit to the Department for prior written approval a marketing plan and all marketing materials prepared pursuant to said plan and this Contract. The MCO must distribute the marketing materials to its entire service area. General member health education brochures and member health education materials do not require approval from the Department. The Department will review the marketing plan and all marketing materials as soon as possible but within 45 days to ensure compliance with this Contract. The MCO agrees to engage only in marketing activities that are pre-approved in writing by the Department.
Marketing Standards. At all times, the Reseller shall conduct its business in a manner that reflects favorably on SplashData and SplashData’s good name, goodwill and reputation. The Reseller shall ensure that its employees and agents maintain the highest level of market standard, of integrity and professionalism in advertising SplashData Products.
Marketing Standards. Developer agrees to conduct its marketing and sales of Derivative Products in a manner that reflects favourably on the Derivative Products and on the reputation and good will of Sideware and its affiliates.

Marketing Standards. 5.1 SALES LITERATURE TCG shall provide Reseller, at Reseller's sole expense, with display materials and with an ongoing supply of sales literature, if available. The copies of such display materials and sales literature will be the property of Reseller. However, the rights preserved to TCG pursuant to the provisions of Section 5.3 hereof will remain with TCG. TCG will provide Reseller with assistance in assembling relevant documentation.
Marketing Standards. (a) Xxxxxxx Mac will have the right, but not the obligation, to review in advance Software Vendor's advertisements, press releases, brochures, videotapes, audiovisual materials, sales collateral, newsletters, other written and oral presentations related to the Interface and other similar materials (collectively "Marketing Materials") to confirm that such materials are consistent with Xxxxxxx Mac's guidelines for Marketing Materials related to the System. In no event will Software Vendor have the right to use Xxxxxxx Mac's name or logo or any service xxxx belonging to Xxxxxxx Mac, including, without limitation, the marks "Xxxxxxx Mac"(R) and "Loan Prospector"(SM) Service except strictly in accordance with Xxxxxxx Mac's written guidelines therefor or as consented to by Xxxxxxx Mac. A current copy of Xxxxxxx Mac's guidelines for Marketing Materials and use of Xxxxxxx Mac's service marks is attached hereto as Exhibit C.
