Common use of Installation of Equipment Clause in Contracts

Installation of Equipment. This plan includes standard professional installation of one (1) satellite modem, one (1) antenna, one (1) TRIA, and mounting hardware. You represent that there are no legal, contractual or similar restrictions on the installation of the DISH Equipment, the antenna or mounting hardware in location(s) you have authorized. It is your responsibility to ensure compliance with all applicable building codes, zoning ordinances, homeowners’ association rules, covenants, conditions, and restrictions related to services provided under this Agreement, to pay any prices, fees and charges, and obtain any permits or authorizations necessary for services provided under this Agreement (collectively, “Legal Requirements”). You are solely responsible for any fines or similar charges for service in violation of any applicable Legal Requirements. You acknowledge and agree that DISH or DISH’s designated affiliate, service provider, retailer or other independent contractor will be required to access your premises to install and maintain the DISH Equipment, as well as the antenna, mounting hardware and any other components necessary for you to receive the Service, whether installed inside or outside your location. This may include, without limitation, attaching a satellite modem to your computer, installing software on your computer and configuring your computer for optimized performance of the Service. By scheduling installation or after-sales services and permitting DISH or DISH’s affiliate, service provider, retailer or other independent contractor to enter your premises, you are authorizing DISH or DISH’s affiliate, service provider, retailer, or other independent contractor to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). You are responsible for backing up the data on your computers and DISH highly recommends that you do so prior to permitting access to DISH or one of DISH’s designated affiliates, service providers, retailers or other independent contractors. This limitation does not apply to any damages arising from the gross negligence or intentional misconduct of any installation or maintenance service provider. Timeframes for installation, if any, are not guaranteed and may vary depending on the types of services requested and other factors. RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”), THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISH, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENT.

This may include, without limitation, will include attaching a satellite modem to your computer, installing software on your computer and configuring your computer for optimized performance of the Service. By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premiseshome, you are authorizing DISH or DISH’s affiliate, ViaSat and our service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS NEITHER VIASAT NOR RIO GRANDE ELECTRIC COOPERATIVE/RIONET SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S)COMPUTER. You acknowledge and agree that DISH Green Hills or DISH’s our designated affiliate, service provider, retailer or other independent contractor provider will be required to access your premises and system to install and maintain the DISH Green Hills Equipment, as well as including the antennaantenna and its components, mounting hardware and any other components necessary for you to receive the Service, whether installed Service inside or and outside your locationhome. This may include, without limitation, will include attaching a satellite modem to your computer, installing software on your computer and configuring your computer for optimized performance of the Service. By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premiseshome, you are authorizing DISH or DISH’s affiliate, Green Hills and our service provider, retailer, or other independent contractor provider to perform all of the above actions. You acknowledge and agree that DISH Viasat or DISH’s its designated affiliate, service provider, retailer or other independent contractor provider will be required to access your premises and computer to install and maintain the DISH Equipment, as well as the antenna, mounting hardware and any other components necessary for you to receive the Service, whether installed inside or outside your location. This may include, without limitation, will include attaching a satellite modem the Equipment to your computer, installing software on your computer . You confirm that you have reviewed the installation plan and configuring your computer for optimized performance of the Serviceagreed to any associated charges. By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premises, you are authorizing DISH or DISH’s affiliate, Viasat and its service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). You are responsible for backing up the data on your computers computer and DISH we highly recommends recommend that you do so prior to permitting access to DISH us or one of DISH’s our designated affiliates, service providers. NEITHER VIASAT NOR ITS SERVICE PROVIDER SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM THE EQUIPMENT OR ANY INSTALLATION, retailers or other independent contractorsREPAIR OR OTHER SERVICES ASSOCIATED WITH THE EQUIPMENT, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER. This limitation does not apply to any damages arising from the gross negligence or intentional willful misconduct of any installation us or maintenance one of our designated service providerproviders. Timeframes Time frames for installation, if any, are not guaranteed and may vary depending on the types of services requested and other factors. RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”)If we determine in our sole discretion that there are unacceptable hazards associated with the installation, THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISHwe may discontinue the installation at any point and terminate this Agreement without liability. In such a case, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENTyou will not incur a Termination Fee.

This may include, without limitation, will include attaching a satellite modem modem(s) to your computercomputer(s), installing software on your computer computer(s) and configuring your computer computer(s) for optimized performance of the Service. By scheduling installation or after-after- sales services and permitting DISH or DISH’s us, our affiliate, service provider, retailer or other independent contractor to enter your premises, you are authorizing DISH or DISH’s us, our affiliate, service provider, retailer, or other independent contractor to perform all of the above actions. NONE OF YOUR SUPPLIERVIASAT, DISH OR DISH’S OUR DESIGNATED AFFILIATESAFFILIATE, SERVICE PROVIDERSPROVIDER, RETAILERS RETAILER OR OTHER INDEPENDENT CONTRACTORS CONTRACTOR SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). This may include, without limitation, will include attaching a satellite modem to your computer, installing software on your computer computer, if applicable, and configuring your computer for optimized performance of the Service. By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premiseshome, you are authorizing DISH ViaSat or DISH’s affiliate, our service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, NEITHER SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS PROVIDER NOR OUR SERVICE PROVIDER SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S)COMPUTER. You are responsible for backing up the data on your computers computer and DISH we highly recommends recommend that you do so prior to permitting access to DISH us or one of DISH’s our designated affiliates, service providers, retailers or other independent contractors. This limitation does not apply to any damages arising from the gross negligence or intentional misconduct of any installation or maintenance service provider. Timeframes for installation, if any, are not guaranteed and may vary depending on the types of services requested and other factors. RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”), THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISH, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENT.

Installation of Equipment. This plan includes standard professional installation of one (1) satellite modem, one (1) antenna, one (1) TRIA, and mounting hardware. You represent that there are no legal, contractual or similar restrictions on the installation of the DISH Equipment, ViaSat/Northland Connect Equipment in the antenna or mounting hardware in location(s) you have authorized. It is your responsibility to ensure compliance with all applicable building codes, zoning ordinances, homeowners’ association rules, covenants, conditions, and restrictions related to services provided under this Agreementthe Services, to pay any prices, fees and or other charges, and to obtain any permits or authorizations necessary for services provided under this Agreement the Services (collectively, “collectively "Legal Requirements”"). You are solely responsible for any fines or similar charges for service in violation of any applicable Legal Requirements. You acknowledge and agree that DISH Northland Connect or DISH’s our designated affiliate, service provider, retailer or other independent contractor provider will be required to access your premises and system to install and maintain the DISH ViaSat Equipment, as well as including the antennaantenna and its components, mounting hardware and any other components necessary for you to receive the Service, whether installed Service inside or and outside your locationhome. This may include, without limitation, will include attaching a satellite modem to your computer, installing software on your computer and configuring your computer for optimized performance of the Service. By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premiseshome, you are authorizing DISH or DISH’s affiliate, Northland Connect and our service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, NEITHER NORTHLAND CONNECT NOR OUR SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS PROVIDER SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S)COMPUTER. You are responsible for backing up the data on your computers computer and DISH we highly recommends recommend that you do so prior to permitting access to DISH us or one of DISH’s our designated affiliates, service providers, retailers or other independent contractors. Installation of Equipment. This plan includes standard professional The Subscriber shall allow Zinia or its approved representative to carry out such work at the Subscriber’s premises as is necessary to effect installation and/or implementation and provision of one (1) satellite modemthe Services. The Subscriber hereby indemnifies Zinia, one (1) antennaits directors, one (1) TRIAemployees, agents or approved representatives against any all loss, damages, costs and mounting hardwareexpenses, which may be incurred as a result of performing such installation and/or implementation. You represent that there are Zinia shall not in any matter whatsoever be liable for the acts or omissions of whatsoever nature of its approved representatives/agents and or any other party. Nothing in this Agreement confers, or shall be deemed to confer, on the Subscriber any rights in, or license to use, any intellectual property of Zinia. The Subscriber shall make no legalcopies of manuals, contractual documentation, computer programs or similar restrictions intellectual property without the prior written consent of Zinia, nor will the Subscriber use or display the Zinia brand or logo on any document or equipment without Zinia’s prior written consent. The Subscriber hereby expressly acknowledges that installation timeframes provided by ZInia are guidelines only and cannot be guaranteed as various elements of the installation and/or implementation process are dependent on third party service providers and government departments. Accordingly, the Subscriber acknowledges and agrees that it shall not be entitled to cancel this Agreement as a result of any delay in installation and/or implementation, save in circumstances where installation and/or implementation will not be effected within the foreseeable future. Zinia undertakes to provide regular updates to the Subscriber in order to ensure the Subscriber is aware of any delays and/or hindrances in the installation process. RAPID DEPLOYMENT As a value-added service to the Subscriber, the Subscriber shall be entitled to request temporary connectivity services offered by Zinia in order to assist the Subscriber with temporary connectivity (“Rapid Deployment Services”) pending the installation and implementation of the Services. The costs of the Rapid Deployment Services shall be quoted by Zinia at the time same are requested by the Subscriber and based on the installation Subscriber’s stated requirements, which amount (or any pro-rated portion thereof) are to be paid on a month-to-month basis for so long as the Rapid Deployment Services are utilised by the Subscriber, as reflected in the Schedules. The Rapid Deployment Services are, by their nature, temporary and dependent on numerous external elements beyond the reasonable control of the DISH Equipment, the antenna or mounting hardware in location(s) you have authorizedZinia. It is your responsibility Zinia shall use reasonable commercial endeavours to ensure compliance with all applicable building codesthat the Rapid Deployment Services meet the Subscriber’s requirements, zoning ordinanceshowever, homeowners’ association rulesZinia gives no warranties as to performance or reliability. To the extent that the Rapid Deployment Services are intermittent, covenantsinconsistent, conditionsor do not meet the Subscriber’s connectivity requirements, and restrictions related to services provided under this Agreementwill not, to pay in any pricesway, fees and charges, and obtain any permits or authorizations necessary constitute grounds for services provided under the termination of this Agreement (collectively, “Legal Requirements”). You are solely responsible for any fines or similar charges for service in violation of any applicable Legal Requirements. You acknowledge and agree that DISH or DISH’s designated affiliate, service provider, retailer or other independent contractor will the Subscriber shall not be required entitled to access your premises to install and maintain rely on the DISH Equipment, as well as the antenna, mounting hardware and any other components necessary for you to receive the Service, whether installed inside or outside your location. This may include, without limitation, attaching a satellite modem to your computer, installing software on your computer and configuring your computer for optimized performance of the Service. By scheduling installation or after-sales services and permitting DISH or DISH’s affiliate, service provider, retailer or other independent contractor Rapid Deployment Services to enter your premises, you are authorizing DISH or DISH’s affiliate, service provider, retailer, or other independent contractor to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). You are responsible for backing up the data on your computers and DISH highly recommends that you do so prior to permitting access to DISH or one of DISH’s designated affiliates, service providers, retailers or other independent contractors. This limitation does not apply to any damages arising from the gross negligence or intentional misconduct withhold payment of any installation amounts owing to Zinia or maintenance service provider. Timeframes for installation, if any, are not guaranteed and may vary depending on the types of services requested and other factors. RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”), THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISH, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENTplace Zinia in breach.

This may includeincluding, without limitation, the antenna and its components. This will include attaching a satellite modem the Equipment to your computer, installing software on your computer and configuring your computer for optimized to optimize the performance of the Internet Service. You confirm that you have reviewed the installation plan and agreed to any associated charges. If you approved a roof mount, you acknowledge the potential risks associated with this type of installation (including, without limitation, with respect to any warranty that applies to your roof or roof membrane). By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premises, you are authorizing DISH or DISH’s affiliate, ViaSat and its service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). You are responsible for backing up the data on your computers computer and DISH we highly recommends recommend that you do so prior to permitting access to DISH us or one of DISH’s our designated affiliates, service providers. NEITHER VIASAT NOR ITS SERVICE PROVIDER SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM THE EQUIPMENT OR ANY INSTALLATION, retailers or other independent contractorsREPAIR OR OTHER SERVICES ASSOCIATED WITH THE EQUIPMENT, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER. This limitation does not apply to any damages arising from the gross negligence or intentional willful misconduct of any installation us or maintenance one of our designated service providerproviders. RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”)If we determine in our sole discretion that there are unacceptable hazards associated with the installation, THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISHwe may discontinue the installation at any point and terminate this Agreement without liability. In such a case, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENTyou will not incur a Termination Fee.

NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). This may includeincluding, without limitation, attaching the antenna and its components. You confirm that you have reviewed the installation plan and agreed to any associated charges. If you approved a satellite modem roof mount, you acknowledge the potential risks associated with this type of installation (including, without limitation, with respect to any warranty that applies to your computer, installing software on your computer and configuring your computer for optimized performance of the Serviceroof or roof membrane). By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premises, you are authorizing DISH or DISH’s affiliate, Expedition Communications and its service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”), THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISH, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENT.

Installation of Equipment. This plan includes standard professional installation of one (1) satellite modem, one (1) antenna, one (1) TRIA, and mounting hardware. You represent that there are no legal, contractual or similar restrictions on the installation of the DISH Equipment, the antenna or mounting hardware WildBlue Equipment in location(s) you have authorized. It is your responsibility to ensure compliance with all applicable building codes, zoning ordinances, homeowners’ association rules, covenants, conditions, and restrictions related to services provided under this Agreement, to pay any prices, fees and or other charges, and obtain any permits or authorizations necessary for services provided under this Agreement agreement (collectively, “collectively "Legal Requirements”"). You are solely responsible for any fines or similar charges for service in violation of any applicable Legal Requirements. You acknowledge and agree that DISH we or DISH’s designated affiliate, our service provider, retailer or other independent contractor provider will be required to access your premises or system and to install and maintain the DISH WildBlue Equipment, as well as including the antennadish and its components, mounting hardware and any other components necessary for you to receive the Service, whether installed Service inside or and outside your locationhome. This may include, without limitation, will include attaching a satellite Satellite modem to your computer, installing software on your computer computer, if applicable, and configuring your computer for optimized performance of the Service. By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premiseshome, you are authorizing DISH WildBlue or DISH’s affiliate, our service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, NEITHER SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS PROVIDER NOR OUR SERVICE PROVIDER SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S)COMPUTER. You are responsible for backing up the data on your computers computer and DISH we highly recommends recommend that you do so prior to permitting access to DISH us or one of DISH’s our designated affiliates, service providers, retailers or other independent contractors. This limitation does not apply to any damages arising from the gross negligence or intentional misconduct of any installation or maintenance service provider. Timeframes for installation, if any, are not guaranteed and may vary depending on the types of services requested and other factors. This may includeincluding, without limitation, attaching the antenna and its components. You confirm that you have reviewed the installation plan and agreed to any associated charges. If you approved a satellite modem roof mount, you acknowledge the potential risks associated with this type of installation (including, without limitation, with respect to any warranty that applies to your computer, installing software on your computer and configuring your computer for optimized performance of the Serviceroof or roof membrane). By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premises, you are authorizing DISH or DISH’s affiliate, Mobil Satellite Technologies and its service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). You are responsible for backing up the data on your computers computer and DISH we highly recommends recommend that you do so prior to permitting access to DISH us or one of DISH’s our designated affiliates, service providers. NEITHER MOBIL SATELLITE TECHNOLOGIES NOR ITS SERVICE PROVIDER SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM THE EQUIPMENT OR ANY INSTALLATION, retailers or other independent contractorsREPAIR OR OTHER SERVICES ASSOCIATED WITH THE EQUIPMENT, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER. This limitation does not apply to any damages arising from the gross negligence or intentional willful misconduct of any installation us or maintenance one of our designated service providerproviders. Timeframes Time frames for installation, if any, are not guaranteed and may vary depending on the types of services requested and other factors. RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”)If we determine in our sole discretion that there are unacceptable hazards associated with the installation, THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISHwe may discontinue the installation at any point and terminate this Agreement without liability. In such a case, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENTyou will not incur a Termination Fee.

This may include, without limitation, attaching a satellite modem to your computer, installing software on your computer and configuring your computer for optimized performance of the Service. By scheduling installation or after-sales services and permitting DISH or DISH’s affiliate, service provider, retailer or other independent contractor to enter your premises, you are authorizing DISH or DISH’s affiliate, service provider, retailer, or other independent contractor to perform all of the above actions. This may include, without limitation, will include attaching a satellite modem to your computer, installing software on your computer and configuring your computer for optimized performance of the Service. This may include, without limitation, will include attaching a satellite modem the Equipment to your computer, installing software on your computer and configuring your computer for optimized to optimize the performance of the Internet Service. You confirm that you have reviewed the installation plan and agreed to any associated charges. If you approved a roof mount, you acknowledge the potential risks associated with this type of installation. By signing this Agreement, scheduling a service or installation or after-sales services visit, and permitting DISH us or DISH’s affiliate, our service provider, retailer or other independent contractor provider to enter your premises, you are authorizing DISH or DISH’s affiliate, ViaSat and its service provider, retailer, or other independent contractor provider to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR OR OTHER SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S). You are responsible for backing up the data on your computers computer and DISH we highly recommends recommend that you do so prior to permitting access to DISH us or one of DISH’s our designated affiliates, service providers. NEITHER VIASAT NOR ITS SERVICE PROVIDER SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM THE EQUIPMENT OR ANY INSTALLATION, retailers or other independent contractorsREPAIR OR OTHER SERVICES ASSOCIATED WITH THE EQUIPMENT, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES OR LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER. This limitation does not apply to any damages arising from the gross negligence or intentional willful misconduct of any installation us or maintenance one of our designated service providerproviders. Timeframes Time frames for installation, if any, are not guaranteed and may vary depending on the types of services requested and other factors. RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”)If we determine in our sole discretion that there are unacceptable hazards associated with the installation, THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISHwe may discontinue the installation at any point and terminate this Agreement without liability. In such a case, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENTyou will not incur a Termination Fee.

It is your responsibility to ensure compliance with all applicable building codes, zoning ordinances, homeowners’ ' association rules, covenants, conditions, and restrictions related to services provided under this Agreementagreement, to pay any prices, fees and or other charges, and to obtain any permits or authorizations necessary for services provided under this Agreement agreement (collectively, “collectively "Legal Requirements”Requirement"). You are solely responsible for any fines or similar charges for service in violation of any applicable Legal Requirements. You acknowledge and agree that DISH or DISH’s designated affiliate, service provider, retailer or other independent contractor XxxxxXXX will be required to access your premises or system and to install and maintain the DISH ClearSKY Equipment, as well as including the antennaantenna and its components, mounting hardware and any other components necessary for you to receive the Service, whether installed Service inside or and outside your locationhome. By signing this agreement, scheduling a service or installation or after-sales services visit, and permitting DISH or DISH’s affiliate, service provider, retailer or other independent contractor us to enter your premises, you are authorizing DISH or DISH’s affiliate, service provider, retailer, or other independent contractor ClearSKY to perform all of the above actions. NONE OF YOUR SUPPLIER, DISH OR DISH’S DESIGNATED AFFILIATES, SERVICE PROVIDERS, RETAILERS OR OTHER INDEPENDENT CONTRACTORS CLEARSKY SHALL NOT HAVE ANY LIABILITY WHATSOEVER FOR ANY LOSSES RESULTING FROM INSTALLATION, REPAIR REPAIR, OR OTHER SERVICES, INCLUDING, INCLUDING WITHOUT LIMITATION, DAMAGE TO YOUR PREMISES, LOSS OF SOFTWARE, DATA OR OTHER INFORMATION FROM YOUR COMPUTER(S)COMPUTER. This limitation does not apply to any damages arising from the gross negligence or intentional misconduct of any installation or maintenance service provider. Timeframes for installation, if any, are not guaranteed and may vary depending on the types of services requested and other factors. RESIDENTS OF ALASKA ONLY: IN THE EVENT THAT DISH DETERMINES THAT YOU ARE A RESIDENT OF A REMOTE AREA OF ALASKA (“REMOTE AREA”), THEN YOU ACKNOWLEDGE AND AGREE THAT: (A) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL FURNISH, OR HAVE ANY OBLIGATION TO FURNISH, ANY INSTALLATION SERVICES TO YOU AT ANY TIME; (B) YOU ARE SOLELY RESPONSIBLE FOR INSTALLING ANY AND ALL DISH EQUIPMENT, ANTENNA(S) AND MOUNTING HARDWARE; (C) YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL RISKS ASSOCIATED WITH AND RESULTS OF SUCH INSTALLATION (INCLUDING, WITHOUT LIMITATION, RECURRING MATERIAL INTERFERENCE OF SIGNAL RECEPTION, LIMITATIONS TO THE QUALITY OR USABILITY OF THE SERVICE, PERSONAL INJURY AND DAMAGE TO THE DISH EQUIPMENT); (D) NEITHER DISH NOR ANY OF DISH’S RETAILERS WILL AT ANY TIME CONDUCT ANY IN-HOME SERVICE CALLS FOR YOU; AND (E) THE FOREGOING DOES NOT RELIEVE YOU OF ANY OF YOUR OBLIGATIONS PURSUANT TO THIS AGREEMENT.
