Common use of For Non-Responsibility Clause in Contracts

For Non-Responsibility. The Lessee agrees that if it is found by the State that the Lessee’s responses to the Retail Disclosure Sheet were intentionally false or intentionally incomplete, on such finding, the Commissioner may terminate this Lease. In addition, upon written notice to the Lessee, and a reasonable opportunity to be heard with appropriate OGS officials, this Lease may be terminated by the Commissioner or his or her designee at the Lessee’s expense where the Lessee is determined by the Commissioner or her designee to be non- responsible. In either event, the Commissioner or her designee may fulfill the Use allowed by this Lease in any manner he or she may deem advisable and pursue available legal or equitable remedies for breach. In no case shall such a termination of the Lease by the State be deemed a breach thereof, nor shall the State be liable for any damages for lost profits or otherwise, that may be sustained by the Lessee as a result of such a termination.
