Common use of Broker’s Commission Clause in Contracts

Broker’s Commission. The parties recognize as the broker(s) who negotiated this Lease the firm(s), if any, whose name(s) is (are) stated in Item 10 of the Basic Lease Provisions, and agree that Landlord shall be responsible for the payment of brokerage commissions to those broker(s) unless otherwise provided in this Lease. Tenant warrants that it has had no dealings with any other real estate broker or agent in connection with the negotiation of this Lease, and Tenant agrees to indemnify and hold Landlord harmless from any cost, expense or liability (including reasonable attorneys' fees) for any compensation, commissions or charges claimed by any other real estate broker or agent employed or claiming to represent or to have been employed by Tenant in connection with the negotiation of this Lease. The foregoing agreement shall survive the termination of this Lease. If Tenant fails to take possession of the Premises or if this Lease otherwise terminates prior to the Expiration Date as the result of failure of performance by Tenant, Landlord shall be entitled to recover from Tenant the unamortized portion of any brokerage commission funded by Landlord in addition to any other damages to which Landlord may be entitled.

The foregoing agreement shall survive the Expiration or earlier termination of this Lease. If Tenant Xxxxxx fails to take possession of the Premises or if this Lease otherwise terminates prior to the Expiration Date as the result of failure of performance by TenantDate, Landlord Lessor shall be entitled to recover from Tenant the unamortized portion of any brokerage commission funded by Landlord Lessor in addition to any other damages to which Landlord Lessor may be entitled.

The foregoing agreement shall survive the termination of this Lease. If Tenant fails to take possession of the Premises premises or if this Lease otherwise terminates prior to the Expiration Date as the result of failure of performance by Tenantexpiration date, Landlord shall be entitled to recover from Tenant the unamortized portion of any brokerage commission funded by Landlord in addition to any other damages to which Landlord may be entitled.

If Tenant Lessee fails to take possession possexxxxx of the Premises or if this Lease otherwise terminates prior to the Expiration Date as the result of failure of performance by TenantDate, Landlord Lessor shall be entitled to recover from Tenant the unamortized portion of any brokerage commission funded by Landlord Lessor in addition to any other damages to which Landlord Lessor may be entitled.

Broker’s Commission. The parties recognize as the broker(s) who negotiated this Lease the firm(s), if any, whose name(s) is (are) stated in Item 10 of the Basic Lease Provisions, and agree that Landlord shall be responsible for the payment of brokerage commissions to those broker(s) unless otherwise provided in this Lease. The commission payable by Landlord to CRESA Partners shall equal Six Hundred Ninety-Three Thousand Four Hundred Ninety Dollars ($693,490.00), based on $5.00 per Building square foot, which commission shall be payable (i) one-half upon mutual execution and delivery of this Lease and the satisfaction or waiver by Tenant of any condition to the effectiveness of this Lease as set forth in Section 3.2 or otherwise, and (ii) the remaining one-half upon Tenant's occupancy of the Premises and the commencement of normal rent payments. Tenant warrants that it has had no dealings with any other real estate broker or agent in connection with the negotiation of this Lease, and Tenant agrees to indemnify and hold Landlord harmless from any cost, expense or liability (including reasonable attorneys' fees) for any compensation, commissions or charges claimed by any other real estate broker or agent employed or claiming to represent or to have been employed by Tenant in connection with the negotiation of this Lease. The foregoing agreement shall survive the termination of this Lease. If Tenant fails to take possession of the Premises or if this Lease otherwise terminates prior to the Expiration Date as the result of failure of performance by Tenant, Landlord shall be entitled to recover from Tenant the unamortized portion of any brokerage commission funded by Landlord in addition to any other damages to which Landlord may be entitled.

If Tenant fails to take possession of the Premises without cause or if this Lease otherwise terminates prior to the Expiration Date as the result of failure of performance by Tenant, Landlord shall be entitled to recover from Tenant the unamortized portion of any brokerage commission brokerxxx xxmmission funded by Landlord in addition to any other damages to which Landlord may be entitled.

If Tenant fails to take possession of the Premises or if this Lease otherwise terminates prior to the Expiration Date as the result of failure of performance by Tenant, Landlord shall be entitled to recover from Tenant the unamortized portion of any brokerage commission funded by Landlord in addition to any other damages to which Landlord may be entitled.

Broker’s Commission. The parties recognize as the broker(s) who negotiated this Lease the firm(s)firms, if any, whose name(s) is (are) names are stated in Item 10 of the Basic Lease Provisions, Provisions and agree that Landlord shall be responsible for the payment of brokerage commissions to those broker(s) brokers unless otherwise provided in this Lease. Tenant warrants that it has had no dealings with any other real estate broker or agent in connection with the negotiation of this Lease, Lease and Tenant agrees to indemnify and hold Landlord harmless from any cost, cost expense or liability (including reasonable attorneys' ’ fees) for any compensation, commissions or charges claimed by any other real estate broker or agent employed or claiming to represent or to have been employed by Tenant in connection with the negotiation of this Lease. The foregoing agreement shall survive the termination of this Lease. Tenant Lessee warrants that it has had no dealings with any other real estate broker or agent in connection with the negotiation of this Lease, and Tenant Lessee agrees to indemnify and hold Landlord Lessor harmless from any cost, expense or liability (including reasonable attorneys' fees) for any compensation, commissions or charges claimed by any other real estate broker or agent employed or claiming to represent or to have been employed by Tenant Lessee in connection with the negotiation of this Lease. The foregoing agreement shall survive the Expiration or earlier termination of this Lease. If Tenant Lessee fails to take possession of the Premises or if this Lease otherwise terminates prior to the Expiration Date as the result of failure of performance by TenantDate, Landlord Lessor shall be entitled to recover from Tenant the unamortized portion of any brokerage commission funded by Landlord Lessor in addition to any other damages to which Landlord Lessor may be entitled.
