Award Conditions. (a) Notwithstanding anything in the Plan or this Agreement to the contrary, to the extent that either (i) the Administrator or the Board of Governors of the Federal Reserve System determines that any change to the Plan and/or this Agreement is required, necessary, advisable, or deemed appropriate to improve the risk sensitivity of the Award, whether by (a) adjusting the Award quantitatively or judgmentally based on the risk the Participant’s activities pose to BB&T or an Affiliate; (b) extending the Performance Period for determining the Award; (c) extending the Performance Period and adjusting for actual losses or other performance issues; or (d) otherwise as required by the Administrator or the Federal Reserve System; or (ii) the Administrator or the United States government (including, without limiting any agency thereof) determines that any change to the Plan and/or this Agreement is required, necessary, advisable, or deemed appropriate to comply with any applicable law, regulation, or requirement; then this Agreement and/or the Award shall be automatically amended to incorporate such change, without further action of the Participant, and the Administrator shall provide the Participant notice thereof.

Award Conditions. This ITB and any bid submitted in response, regardless of whether the bid is determined to be the lowest cost, is not binding upon the Department and does not obligate the Department to procure or contract for any services. Neither the Department nor any party submitting a bid will be bound unless and until the bid is mutually accepted by both parties. The Department will issue a Notice of Award announcing the Department’s selection. The Department will issue a Purchase Order to the awarded Contractor which will represent Department’s acceptance of the Contractor’s bid.
Award Conditions. The participating faculty member agrees to all award conditions outlined in the Faculty Incentive Pay Program, SCP- 2226 and SCP-2226.A, Faculty Incentive Pay Program Criteria. Failure to complete the Incentive Pay Project in its entirety or failure to present of all expected deliverables as outlined in the approved Faculty Incentive Pay Project will result in the cancellation of this agreement and the forfeiture of any incentive pay associated with the project. In addition the participant agrees to repay any and all funds received in advance of the satisfactory completion of the approved Faculty Incentive Pay Project must be repaid to the College. Any course(s), material(s), program(s), service(s), and/or any other product(s) developed under the terms of this Faculty Incentive Pay Project become the sole property of Southern West Virginia Community and Technical College and any and all individual intellectual and/or other proprietary rights or claims of the faculty member are waived.

Award Conditions. The City reserves the unqualified right to award by item(s) unless otherwise stipulated, to waive any irregularity in any bid or to reject any and all bids when, in the judgment of the City, the best interest of the City will be served. The award of a Contract will not be made to any Supplier who is in arrears in City taxes. Article V, Chapter 18 of the Detroit City Code, forbids the award of any contract to person(s) who are in arrears of City real estate, personal property and/or income taxes. To ensure compliance with the above ordinance, Suppliers may check the City of Detroit website, www. xxxxxxxxx.xxx. All awards will be made in accordance with the provisions of Article V, Chapter 18 of the Detroit City Code which provides for purchasing and disposition of property consistent with the City Charter.

Standard of delivery Conditions It shall be a Condition of the Award that the Project shall be completed: with the diligence, care, skill, application and precision to be reasonably expected of a competent research provider of projects such as the Project; in accordance with all legal requirements applicable to the Services (including particularly all legal obligations relating to Data Protection, Health and Safety, Insurance, Employment, Clinical Practice and Confidentiality) and all codes of practice applicable to the Recipient; in accordance with all policies and procedures of the Recipient in terms reasonably satisfactory to the Funder. in accordance with the data provider’s information governance requirements Evaluation The Funder may require external evaluation of any aspect of the Project and the Project Outputs and the Recipient shall comply with all reasonable requirements of the Funder and any external evaluator appointed by the Funder in respect of any such evaluation. Payment of Award and eligible expenditure The Funder shall pay to the Recipient the Award set out in Schedule 2, for the eligible expenditure specified in Schedule 4 and in the instalments and on the pre-conditions set out, in Schedule 3. The Recipient shall account for all Award expenditure by reference to the eligible expenditure specified in Schedule 4 and shall return any sum not applied to eligible expenditure within three months of the end of the Award Period, or within one month of any written request for such repayment based on a final audit of the Award (whichever is the earlier). The Recipient shall keep and maintain reasonable, full and accurate financial records demonstrating application of the Award funds, including all relevant evidentiary documentation, such as receipts and invoices.
