Administration and Oversight a. Monthly Eligibility File Submissions: Beginning June 2013, Washington must submit a monthly eligibility file to CMS’ beneficiary alignment contractor. This data will be updated into CMS’ Master Database Management (MDM) system for beneficiary attribution purposes, and used by the evaluation contractor to identify the eligible population.

Administration and Oversight. The Executive Board will have final decision-making authority on behalf of SSHA3P over all legislative priorities and administrative matters within the scope of this Agreement. The Executive Board may delegate responsibility for general oversight of the operations of SSHA3P to an Executive Manager. The SSHA3P Executive Manager will submit quarterly budget performance and progress reports on the status of the work program elements to the Executive Board and annually to the legislative body of each Party. The reports and their contents will be in a form acceptable to the Executive Board. The Executive Board will, by two-thirds supermajority vote, designate one or more of the Parties to serve as the Administering Agency, which will provide administrative support services on behalf of SSHA3P. To change the Administering Agency, the Executive Board will, by two-thirds supermajority vote, designate one or more of the Parties to serve as the Administering Agency. Each Party that serves in the capacity of Administering Agency hereby agrees to comply with the terms of this Agreement applicable to the Administering Agency in order to permit SSHA3P to carry out its purposes. SSHA3P will be staffed with personnel funded by the Parties and/or independent contractors contracting with the Administering Agency on behalf of SSHA3P. Any Party providing personnel to SSHA3P will remain solely responsible for the continued payment of all compensation and benefits to those personnel as well as for any worker's compensation claims. All Parties will cooperate fully in assisting SSHA3P to provide the services authorized in this Agreement.

Administration and Oversight. The Program Manager will oversee each Supporting Entity’s performance of its responsibility for carrying out a specific task. Decisions by the Program Manager to engage another entity in the implementation of specific Plan elements or actions will be accomplished by written contract (through the existing authorities of an Authorized Entity) and will be based on the entity’s jurisdictional authority, level of expertise, and its capacity to carry out the element or action in a timely and successful manner. The Program Manager, with the concurrence of the Authorized Entity Group, may terminate a Supporting Entity’s role in Plan implementation in the event that the Supporting Entity does not perform a task adequately. The Supporting Entity will be responsible, subject to oversight by the Program Manager, for entering into the necessary contracts and acquiring interests in real and personal property, in some cases obtaining permits or other authorizations, and taking all other steps needed to complete the implementation task. The Take authorizations that will be issued pursuant to the BDCP will provide regulatory coverage under the ESA and the NCCPA for all activities and actions covered by the Plan. As such, no additional Take authorizations will be required to implement these activities, regardless of whether the action is carried out by the Implementation Office or a Supporting Entity. The Permittees shall remain ultimately responsible for compliance with the Plan, this Agreement, and the associated regulatory authorizations.
Administration and Oversight. FVWDB shall oversee and administer Workforce Development Funds despite their transfer to Workforce Economics as described above. FVWDB shall have, in addition to other general administrative rights, the right to review the budget of Workforce Economics and oversee the process of distribution of funds utilized by Workforce Economics, as well as generally oversee its continued operations and use of Workforce Development Board Funds. FVWDB may, at its sole discretion, demand the return of any and all funds provided to Workforce Economics or terminate future distributions to Workforce Economics in the event that the operations of Workforce Economics fail to meet with the approval of FVWDB in any respect. FVWDB shall monitor and ensure the effectiveness of performance by Workforce Economics and its programs and recipients.
