Tenant acknowledges and agrees that Tenant shall not park nor permit any officer, employee, customer or invitee of Tenant to park in any area or in any parking spaces whether in the Parking Facilities or otherwise that is not public parking unless authorized, as applicable, by Resort Owner, Landlord or such other Person as is entitled to authorize such parking.

If a Resort Owner owns more than one interval interest at the Resort, they shall only be counted as one Active Owner for purposes of this Agreement.
Each Residence Owner hereby assumes all risks of an accident, injury and/or property damage arising out of the use of the Resort (including without limitation the Resort Amenities) by Residence Owner (and their family members, guests and tenants) except to the extent caused by the gross negligence or willful misconduct of Resort Owner and/or Resort Operator.
Accordingly, Residence Owner hereby waives any and all claims against Resort Owner and Resort Operator arising from any such accident, injury and/or property damage, and acknowledges and agrees that Resort Owner would not have entered into this Agreement without such waiver having been made.
