Punchlist Work definition

Punchlist Work means and be deemed to refer to a list of Work compiled at the time of the Realized Date of Substantial Completion that is composed of incomplete or otherwise Defective Work that is of a such a minor nature and magnitude that it can, with respect to each item, be completed without disruption of UGAA’s ongoing operations or use of the subject structure and/or site and that it can be completed within thirty days of the Realized Date of Substantial Completion. Incomplete or Defective Work that is more-than-minor in nature or magnitude (i.e., which does not satisfy this definition) cannot be deemed mere Punchlist Work – and its existence will, at the election of UGAA, preclude realization of “Substantial Completion.”
Punchlist Work means any item of Work that: (a) Client reasonably identifies or EPC Contractor identifies at the time of Substantial Completion as defective or requiring completion;

Examples of Punchlist Work in a sentence

More Definitions of Punchlist Work

Punchlist Work is defined as minor or insubstantial incomplete work or details or defects of construction, decoration or mechanical adjustments that do not significantly affect Tenant’s use of the Premises for the Permitted Use (without taking into effect Tenant’s specific manner of use). Notwithstanding the foregoing, if any delay in the Substantial Completion of the Landlord’s Work or the MUA Work by Landlord is due to Tenant Delays, then the Substantial Completion Date shall be deemed to be the date Landlord’s Work or the MUA Work (or the applicable portion of either) would have been Substantially Complete, if not for such Tenant Delays, as reasonably determined by Landlord (provided, that Tenant shall not be entitled to take possession of the Premises until the Premises are in fact Substantially Complete and Landlord shall not be relieved of its obligation to continue using commercially reasonable efforts to Substantially Complete Landlord’s Work or the MUA Work). “Tenant Delays” shall mean delays caused by: (A) requirements of the Space Plans or Plans requested by Tenant that do not conform to Landlord’s building standards for build out, or which contain long lead-time or non-standard items requested by Tenant; (B) any material change in the Space Plans or Plans, once approved, requested by Xxxxxx; (C) any request by Tenant for a delay in the commencement or completion of Landlord’s Work or the MUA Work for any reason; or (D) any other act or omission of Tenant or its employees, agents or contractors which reasonably inhibits the Landlord from timely completing the Landlord’s Work or the MAU Work, including any failure by Tenant to timely respond to plan submissions and approvals for Landlord’s Work. Within fourteen (14) business days after the Term Commencement Date, Landlord and Tenant shall confer and create a specific list of any Punchlist Work remaining items of work with respect to the Landlord’s Work (a “Punchlist”) which work shall be completed as set forth above. Punchlist Work means all incomplete minor elements of the Work identified in accordance with this Agreement following Substantial Completion and as agreed between the Parties.
