Phase 1 definition

Phase 1 means the phase of the ATP comprised of: (1) improvements to the State Street Substation; (2) construction of the Proposed Line; (3) the rebuilding of NYSEG’s existing Lines 971 and 000 xxxxx xx Xxxxxxxx Xxxx xx the NYSEG ROW to allow for construction of the Proposed Line as intended; (4) improvements to the Elbridge Substation to accept the Proposed Line; and (5) National Grid’s conveyance to NYSEG of the NYSEG Acquired ROW and such other land interests as contemplated by the Purchase and Sale Agreement.

Phase 1 means the first implementation phase of this section, beginning June 1, 2018 and ending May 31, 2022.

Phase 1 means a human clinical trial of a Molecule or Product, the principal purpose of which is a preliminary determination of safety, tolerability, pharmacological activity or pharmacokinetics in healthy individuals or patients or similar clinical study prescribed by the Regulatory Authorities, including the trials referred to in 21 C.F.R. §312.21(a), as amended.

• Nor is the City warranting that it will have throughout the term of this Agreement and the Notes the continuing legal ability under State law to apply Available Tax Increment to the payment of the Phase 1 Note and the Phase 2 Note, or Remaining Available Tax Increment to the payment of the Additional Phase 2 Note, which continued legal ability is a condition precedent to the City's obligations under the Notes.

• Each Applicable Developer acknowledges that the City has made no warranties or representations to the Developer as to the amounts of Tax Increment that will be generated or that the Available Tax Increment will be sufficient to pay the Phase 1 Note or Phase 2 Note, or the Remaining Available Tax Increment will be sufficient to pay the Additional Phase 2 Note, in whole or in part.

• Each Applicable Developer understands that the Available Tax Increments pledged to the payment of the Phase 1 Note or the Phase 2 Note, and the Remaining Available Tax Increments pledged to the payment of the Additional Phase 2 Note, are derived from real estate taxes on such Applicable Developer's Phase, which taxes must be promptly and timely paid.

• Set for completion in 2020, the development will be in two phases, of which Phase 1 (Park Area excluding the seafront retail F&B) is slated for completion by mid-2018.

• The parties agree that the income and rent restrictions under this Section 4.5, related to Phase 1, shall terminate on the Termination Date.

More Definitions of Phase 1

Phase 1 means the time period beginning upon the date this Change Order is executed and ending on the date a Facility is turned over to Owner.

Phase 1 means the period commencing on the Base Date and ending on the Phase 1 implementation date (as defined below);

Phase 1. Facilities" means a functional, top-quality cable park/wakeboard park venue consisting of (i) the portion of Lake Tye compromised of approximately 42 acre in surface area sloped at the banks with overhead towers and cable systems for boat-free wakeboarding to be located on the Land as shown on the Phase 1 Concept Plan; (ii) not to exceed an eight (8) tower wakeboard system; (iii) purchase and installation of lake obstacles, including ramps, jumps and rails; (iv) a starting dock or main cable and beginning cable systems; (v) cut and fill site to form viewing areas and ADA- compliant walkway and access to dock; (vi) temporary office building approximately 15’ by 36’; (vii) temporary storage container; (viii) temporary restroom facilities; (ix) landscaping improvements to viewing area, office area, and crawl-out points; and other improvements to be constructed on the Land more fully described in a submittal (the "Phase 1 Facilities Plan") filed and approved by the City.

Phase 1 means Phase 1A and Phase 1B;

Phase 1 means, in relation to the Thacker Pass Project, the initial 30,000 tpa of lithium carbonate covered in the Thacker Pass TR;

Phase 1 means the lands shown as Phase 1 on Schedule A attached hereto.
