The imposition of liquidated damages in the above circumstances shall not prevent the University from serving a future Notice to Pay rent/Perform Covenant or Quit and /or serving a Summons of Complaint for unlawful detainer.
All Late charges or fees owed by any TENANT(S) shall be collected at the sole discretion of the BROKER and BROKER shall retain any such charges, fees, aforementioned charges and late fees even though they may be defined as “additional rent” in the lease agreement which allows these sums to be placed on a Three Day Notice or other Notice to Pay Rent as given by law.
In the event a Member fails to pay residence charges (as defined in Article 4) when due, or other amounts owing, or fails to render any performance required of the Member on demand under this contract, the BSC may serve a Notice to Pay, Perform Covenant, or Quit, as appropriate, as provided by California law.
In the event the University prepares a Notice to Pay Rent/Perform Covenant due to the Resident’s failure to pay rent or to perform a covenant of the Agreement and (1) the Resident pays said rent or performs said covenant or (2) the University agrees to rescind such Notice, the Resident agrees to pay the University $50.00 as liquidated damages to cover the administrative costs involved in the preparation, service and rescission of said Notice.
In such event, UCR-HS shall serve a three-day Notice to Pay Rent or Quit, Notice to Perform Covenant or Quit, or a Notice to Quit, as applicable.
