In the event that a Fully Transferable Obligation or Conditionally Transferable Obligation is a Qualifying Policy, the Insured Instrument must meet the requirements of the relevant definition and, if the benefit of the Qualifying Policy is not transferred as part of any transfer of the Insured Instrument, the Qualifying Policy must be transferable at least to the same extent as the Insured Instrument.
In the case of a Qualifying Policy and an Insured Instrument, references to the Reference Entity in clause (a) of the definition of Restructuring shall be deemed to refer to the Insured Obligor and the reference to the Reference Entity in clause (b) of the definition of Restructuring shall continue to refer to the Reference Entity.(i) Fully Transferable Obligation and Conditionally Transferable Obligation.
If "Restructuring Maturity Limitation and Fully Transferable Obligation Applicable" is specified in the Issue Terms and Restructuring is the only Credit Event specified in a Credit Event Notice, then a Deliverable Obligation may be specified in the Notice of Physical Settlement and may be included in the Portfolio only if it (i) is a Fully Transferable Obligation and (ii) has a final maturity date not later than the Restructuring Maturity Limitation Date.
Fully Transferable Obligation means a Deliverable Obligation that is either Transferable, in the case of Bonds, or capable of being assigned or novated to all Eligible Transferees without the consent of any person being required, in the case of any Deliverable Obligation other than Bonds.
For the purpose of a Reference Entity in respect of which a Restructuring Credit Event has occurred, and “Restructuring Maturity Limitation and Fully Transferable Obligation” is specified under “Credit Events - Restructuring” as being applicable in the relevant Standard, and Restructuring is the only Credit Event, the Reference Obligation will be an obligation (i) which is a Fully Transferable Obligation and (ii) has a final maturity date not later than the Restructuring Maturity Limitation Date.
