CRADA Data definition

CRADA Data means all recorded information first produced in the performance of the Research Plan.

CRADA Data means information developed by or on behalf of the Parties in the performance of the Research Plan, excluding Raw Data.

CRADA Data means the data contained within the Case Report Form with any additional data described as a deliverable in the SOW. CRADA Data does not include patient medical records or Individually Identifiable Information, except for any that may be contained in the completed Case Report Form.

Examples of CRADA Data in a sentence

• To the extent permitted by law, each Party will have the right to use any and all CRADA Data in and for any regulatory filing by or on behalf of the Party.

• The Parties will be free to utilize CRADA Data and CRADA Materials internally for their own purposes, consistent with their obligations under this CRADA.

• Subject to the Government license described in Paragraph 7.5, the sharing requirements of Paragraph 8.1 and the regulatory filing requirements of Paragraph 8.2, the producing Party will retain sole ownership of and title to all CRADA Subject Inventions, all copies of CRADA Data, and all CRADA Materials produced solely by its employee(s).

• The Parties may share CRADA Data or CRADA Materials with their Affiliates, agents or contractors provided the obligations of this Article 8.2 are simultaneously conveyed.

• Collaborator agrees to hold the Government harmless and to indemnify the Government for all liabilities, demands, damages, expenses and losses arising out of the use by Collaborator for any purpose of the CRADA Data, CRADA Materials or CRADA Subject Inventions produced in whole or part by IC employees under this CRADA, unless due to the negligence or willful misconduct of IC, its employees, or agents.
