Cost Pools definition

Cost Pools shall have the meaning set forth in Section 4.3, below.
Cost Pools shall be: (i) the Apartment Portion, (ii) the Two Xxxxxx Office Portion, (iii) the Two Xxxxxx Retail Portion (iv) the One Xxxxxx Office Portion, and (v) the One Xxxxxx Retail Portion. To the extent operating or tax costs are directly and solely attributable to a specific Cost Pool, such operating or tax costs will be charged directly to such Cost Pool. To the extent operating or tax costs are attributable and allocable to two or more Cost Pools, such Operating Expense will be prorated on a square footage basis amongst such Cost Pools, and therefore, only operating or tax costs attributable to the Two Xxxxxx Office Portion shall be part of Operating Expenses or Tax Expenses. To the extent operating or tax costs are common to all Cost Pools, such Operating Expense will be allocated among the Cost Pools in accordance with the following percentages: (a) Apartment Portion – 30.52%, (b) Two Xxxxxx Office Portion – 27.78%, (c) Two Xxxxxx Retail Portion – 3.05%, (d) One Xxxxxx Office Portion – 32.54%, and (e) One Xxxxxx Retail Portion – 6.11%. The allocation of operating and tax costs between Cost Pools shall be made on an equitable and reasonable basis and in a manner consistent between the Base Year and any subsequent Expense Year.
Cost Pools shall be: (i) the Apartment Portion, (ii) the Two Rincon Office Portion, (iii) the Two Rincon Retail Portion (iv) the Xxx Xincon Office Portion, (v) the Oxx Xxxcon Retail Portion, and (vi) xxx Xx-site Parking Area. To the exxxxx xperating or tax costs are directly and solely attributable to a specific Cost Pool, such operating or tax costs will be charged directly to such Cost Pool based upon an equitable comparison of relative square footage or as otherwise determined by Landlord, in Landlord's sole discretion. To the extent operating or tax costs are attributable and allocable to two or more Cost Pools, such Operating Expense will be prorated on an equitable basis amongst such Cost Pools, and therefore, only operating or tax costs attributable to the One Rincon Office Portion shall be part of Operating Expenses or Tax Exxxxxxx. To the extent operating or tax costs are common to all Cost Pools, such Operating Expense will be allocated among the Cost Pools in accordance with the following percentages: (a) Apartment Portion - 26.492%, (b) Two Rincon Office Portion - 28.176%, (c) Two Rincon Retail Portion - 3.000%, (d) One Rincon Office Portion - 30.000%, (e) One Rincon Retail Portion - 8.000%, and (f) On-site Parking Area - 2.500%.

  • Operating Costs means the incremental expenses incurred by the Recipient on account of Project implementation, management, and monitoring, including for office space rental, utilities, and supplies, bank charges, communications, vehicle operation, maintenance, and insurance, building and equipment maintenance, advertising expenses, travel and supervision, salaries of contractual and temporary staff, but excluding salaries, fees, honoraria, and bonuses of members of the Recipient’s civil service.

  • Operating Cost means the costs associated with operating a DCA funded property after it is placed in service.

  • Direct Expenses means “Operating Expenses” and “Tax Expenses.”

  • Project Expenses means usual and customary operating and financial costs. The term does not include extraordinary capital expenses, development fees and other non-operating expenses.

  • Building Operating Expenses means the portion of “Operating Expenses,” as that term is defined in Section 4.2.7 below, allocated to the tenants of the Building pursuant to the terms of Section 4.3.1 below.

  • Controllable Operating Expenses means all Operating Expenses except: sales, use and any other taxes, cost of insurance, costs of procuring and providing utility services, snow removal costs, landscaping costs, union labor costs (to the extent controlled by a collective bargaining agreement), costs associated with procuring permits and licenses, and costs of complying with all governmental laws and regulations.

No part of Lessee’s central office overhead or general or administrative expense (as opposed to that of the Hotel), and no operating expenses paid or payable by tenants under Space Leases, shall be deemed to be a part of Gross Operating Expenses, as herein provided. Reasonable out-of-pocket expenses of Lessee incurred for the account of or in connection with the Hotel operations, including but not limited to postage, telephone charges and reasonable travel expenses of employees, officers and other representatives and consultants of Lessee and its Affiliates, shall be deemed to be a part of Gross Operating Expenses and such Persons shall be afforded reasonable accommodations, food, beverages, laundry, valet and other such services by and at the Hotel without charge to such Persons or Lessee.

  • Building Project means the aggregate combined parcel of land on a portion of which are the improvements of which the Premises form a part, with all the improvements thereon, said improvements being a part of the block and lot for tax purposes which are applicable to the aforesaid land.

  • Tax Expenses means all federal, state, county, or local governmental or municipal taxes, fees, charges or other impositions of every kind and nature, whether general, special, ordinary or extraordinary, (including, without limitation, real estate taxes, general and special assessments, transit taxes, leasehold taxes or taxes based upon the receipt of rent, including gross receipts or sales taxes applicable to the receipt of rent, unless required to be paid by Tenant, personal property taxes imposed upon the fixtures, machinery, equipment, apparatus, systems and equipment, appurtenances, furniture and other personal property used in connection with the Project, or any portion thereof), which shall be paid or accrued during any Expense Year (without regard to any different fiscal year used by such governmental or municipal authority) because of or in connection with the ownership, leasing and operation of the Project, or any portion thereof.

  • Allocable Overhead means costs incurred by a Party or for its account which are attributable to a Party's supervisory, services, occupancy costs, corporate bonus (to the extent not charged directly to department), and its payroll, information systems, human relations or purchasing functions and which are allocated to company departments based on space occupied or headcount or other activity-based method. Allocable Overhead shall not include any costs attributable to general corporate activities including, by way of example, executive management, investor relations, business development, legal affairs and finance.

  • Allocable Costs means costs allocable to a particular cost objective if the goods or services involved are chargeable or assignable to such cost objective in accordance with relative benefits received or other equitable relationship. Costs allocable to a specific Program may not be shifted to other Programs in order to meet deficiencies caused by overruns or other fund considerations, to avoid restrictions imposed by law or by the terms of this Agreement, or for other reasons of convenience.

  • Ongoing Project means a multi-year project undertaken by a Company in fulfilment of its CSR obligation having timelines not exceeding three years excluding the financial year in which it was commenced, and shall include such project that was initially not approved as a multi-year project but whose duration has been extended beyond one year by the board based on reasonable justification;

  • Parking Facilities means parking lots or other off-street areas for the parking of vehicles, including areas below or above the surface of streets.
