If Tenant institutes such Arbitration procedures, then the Arbitrator shall have the power to, and shall, inquire into and determine not only whether or not the Tenant was overcharged for such Taxes and Cost of Operation and Maintenance, but whether or not the Tenant was undercharged for such Taxes and Cost of Operation and Maintenance.
If the Arbitrator determines that the Tenant was undercharged for Taxes and Cost of Operation and Maintenance, Tenant shall pay the amount of such undercharge to the Landlord within thirty (30) days following the issuance of the Arbitration Ruling.
