Beneficial Interest Certificate definition

Beneficial Interest Certificate has the meaning set forth in the Trust Agreement.
Beneficial Interest Certificate the Beneficial Interest Certificate (as defined in the Trust Agreement) dated the date hereof and executed pursuant to the Trust Agreement. Any reference in this Agreement to the Capital Contribution of a Member shall include a Capital Contribution of its predecessors in interest. Claim ‑ any and all judgments, claims, causes of action, demands, lawsuits, suits, proceedings, Governmental investigations or audits, losses, assessments, fines, penalties, administrative orders, obligations, costs, expenses, liabilities and damages (whether actual, consequential or punitive), including interest, penalties, reasonable attorney=s fees, disbursements and costs of investigations, deficiencies, levies, duties and imposts.
Beneficial Interest Certificate means one or more trust certificates (together with any replacements thereof) issued by the Trust representing the exclusive, undivided beneficial interest in the Trust, in the form of Exhibit A attached hereto.

  • Residual Interest Certificate means any of the Class R-I Certificates, the Class R-II Certificates, the Class R-III Certificates or, if issued in accordance with Section 2.06, the Class R-LR Certificates.
